BILL NUMBER: S5309 TITLE OF BILL : An act to amend the agriculture and markets law, in relation to the inspection and sale of seeds, agricultural liming materials and commercial fertilizer PURPOSE OF THE BILL : The purpose of this bill is to modify the Agriculture and Markets Law (AML) to improve certain provisions which affect the production of agricultural commodities, concerning the inspection and sale of seeds, agricultural liming materials and commercial fertilizer. SUMMARY OF PROVISIONS : Section 1 of the bill would amend AML § 136(2) and (7) to make a technical edit to the definition of "seed" and to expand the definition of "noxious weed seeds." Section 2 of the bill would amend AML § 136, Definitions, to add definitions for the terms "mulch" and "mixture, mix, or mixed." Section 3 of the bill would amend AML § 137(C)(2) to clarify a labeling requirement for agricultural seeds. Section 4 of the bill would amend AML § 137(D)(1) to strengthen the

RITCHIE -- (at request of the Department of Agricul- ture and Markets) -- read twice and ordered printed, and when printed to be committed to the Committee on Agriculture AN ACT to amend the agriculture and markets law, in relation to the inspection and sale of seeds, agricultural liming materials and commercial fertilizer THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivisions 2 and 7 of section 136 of the agriculture and markets law, subdivision 2 as added by chapter 631 of the laws of 1955 and subdivision 7 as amended by chapter 592 of the laws of 2003, are amended to read as follows: 2. The term "seed" means botanical structures used for planting purposes and commonly referred to as "seed" within this state. This includes POTATO tubers [of the Irish potato] when such tubers are represented as being suitable for planting purposes. 7. The term "noxious weed seeds" [includes seeds of bindweed (Convol- vulus arvensis), quackgrass (Elytrigia repens), Canada thistle (Cirsium arvense), bedstraw (Galium spp.), dodder (Cuscuta spp.), horse nettle (Solanum carolinense), wild onion (Allium canadense and A. vineale), corn cockle (Agrostemma githago), and Russian knapweed (Acroptilon repens)] ARE THOSE WEED SEEDS WHICH ARE OBJECTIONABLE IN AGRICULTURE CROPS, LAWNS, AND GARDENS OF THIS STATE AND WHICH CAN BE CONTROLLED BY GOOD AGRICULTURAL PRACTICES OR THE USE OF HERBICIDES. NOXIOUS WEEDS AND THE NUMBER OF SUCH NOXIOUS WEED SEEDS ALLOWABLE PER POUND OF SEED SHALL BE ESTABLISHED IN REGULATION BY THE COMMISSIONER. § 2. Section 136 of the agriculture and markets law is amended by adding two new subdivisions 22 and 23 to read as follows: 22. "MULCH" MEANS A PROTECTIVE COVERING OF ANY SUITABLE SUBSTANCE PLACED WITH SEED WHICH ACTS TO RETAIN SUFFICIENT MOISTURE TO SUPPORT SEED GERMINATION AND SUSTAIN EARLY SEEDLING GROWTH AND AID IN THE EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

BILL NUMBER: S5309A TITLE OF BILL : An act to amend the agriculture and markets law, in relation to the inspection and sale of seeds, agricultural liming materials and commercial fertilizer PURPOSE OF THE BILL : The purpose of this bill is to modify the Agriculture and Markets Law (AML) to improve certain provisions which affect the production of agricultural commodities, i.e., AML Articles 9, 9-A and 10 concerning the inspection and sale of seeds, agricultural liming materials and commercial fertilizer. The bill adds definitions of terms currently used, but not defined in the law; makes the laws more consistent with model laws and the laws of other states; and adds provisions to increase consumer protections against buying sub-standard or adulterated materials, by establishing maximum allowable levels of metals in fertilizer. The bill also adds a specific section to the seed law authorizing "stop sale" orders when products are found to be in violation of the law.
