BILL NUMBER: S5341 TITLE OF BILL : An act to amend the public health law, in relation to extending the authority of the commissioner of health to issue certificates of authority to accountable care organizations PURPOSE OF THE BILL : This bill would extend the authority of the Commissioner of Health to issue certificates of authority to accountable care organizations (ACOs). SUMMARY OF PROVISIONS : Section 1 of the bill would amend subdivision 3 of section 2999-p of the Public Health Law (PHL) to extend the authority of the Commissioner of Health to issue certificates of authority to ACOs from December 31, 2016 to December 31, 2020. Section 2 of the bill would provide for an immediate effective date. JUSTIFICATION : PHL Article 29-E requires the Department of Health (DOH) to establish a program allowing entities to apply for a certificate of authority as an Accountable Care Organization (ACO). HANNON -- (at request of the Department of Health) -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to extending the authority of the commissioner of health to issue certificates of authority to accountable care organizations THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 of section 2999-p of the public health law, as amended by chapter 461 of the laws of 2012, is amended to read as follows: 3. The commissioner may issue a certificate of authority to an entity that meets conditions for ACO certification as set forth in regulations made by the commissioner pursuant to section twenty-nine hundred nine- ty-nine-q of this article. The commissioner shall not issue any new certificate under this article after December thirty-first, two thousand [sixteen] TWENTY. § 2. This act shall take effect immediately.
