BILL NUMBER: S5346 TITLE OF BILL : An act to amend the penal law, in relation to unlawfully installing gas meters PURPOSE OR GENERAL IDEA OF BILL : This bill would make installing or having knowledge of an unlawfully installed gas meter a class B misdemeanor. SUMMARY OF SPECIFIC PROVISIONS : New York Penal Law Section 270.40 recognizes that a person is guilty of unlawfully installing gas meters when he or she installs the gas meters; is the owner of the premises where the meters are unlawfully installed; or otherwise knows the meters are unlawfully installed. Unlawfully installing gas meters is a class B misdemeanor. Section two provides that this act shall take effect immediately. JUSTIFICATION : The purpose of this bill is to not only prevent theft of services from gas companies, but also protect citizens from the potential hazards of

The penal law is amended by adding a new section 270.40 to read as follows: § 270.40 UNLAWFULLY INSTALLING GAS METERS. 1. AS USED IN THIS SECTION "GAS METERS" MEANS ALL GAS METERS THAT MEASURE USAGE OF ANY END USE CUSTOMER OF GAS SERVICES. 2. A PERSON IS GUILTY OF UNLAWFULLY INSTALLING GAS METERS WHEN HE OR SHE INSTALLS THE GAS METERS; IS THE OWNER OF THE PREMISES WHERE THE METERS ARE UNLAWFULLY INSTALLED; OR OTHERWISE KNOWS THE METERS ARE UNLAWFULLY INSTALLED. UNLAWFULLY INSTALLING GAS METERS IS A CLASS B MISDEMEANOR. § 2. This act shall take effect immediately.
