BILL NUMBER: S5508 TITLE OF BILL : An act to amend the public officers law, in relation to residency requirements for clerk-treasurer or deputy clerk-treasurer in the village of Fair Haven PURPOSE OR GENERAL IDEA OF BILL : This bill would allow the Village of Fair Haven to appoint a Clerk-Treasurer or Deputy Clerk-Treasurer who resides outside of the village, as long as they live in Cayuga County, or an adjoining county SUMMARY OF PROVISIONS : Section 3 of the public officers law is amended by adding a new subdivision 66 to allow the clerk-treasurer and deputy clerk-treasurer of the Village of Fair Haven to reside within Cayuga county or an adjoining county JUSTIFICATION : Fair Haven, a village of 750 full time residents, many of them children or elderly, has requested this legislation in order to expand their pool of qualified candidates to fill these positions PRIOR LEGISLATIVE HISTORY :

Section 3 of the public officers law is amended by adding a new subdivision 66 to read as follows: 66. IN THE VILLAGE OF FAIR HAVEN, CAYUGA COUNTY, THE PROVISIONS OF THIS SECTION REQUIRING A PERSON TO BE A RESIDENT OF THE POLITICAL SUBDI- VISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER OFFICIAL FUNCTIONS ARE REQUIRED TO BE EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE OFFICE OF CLERK-TREASURER OR DEPUTY CLERK-TREASURER OF THE VILLAGE OF FAIR HAVEN, PROVIDED THAT SUCH PERSON RESIDES IN THE COUNTY IN WHICH SUCH TOWN IS LOCATED OR AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK. § 2. NOTWITHSTANDING ANY PROVISIONS OF THIS CHAPTER OR ANY OTHER GENER- AL LAW, LOCAL LAW, ORDINANCE OR SPECIAL ACT, THE VILLAGE BOARD OF TRUS- TEES OF THE INCORPORATED VILLAGE OF FAIR HAVEN, CAYUGA COUNTY, MAY, BY RESOLUTION, PROVIDE THAT THE OFFICE OF VILLAGE CLERK-TREASURER OR DEPUTY CLERK OF SUCH VILLAGE MAY BE HELD BY A PERSON WHO IS NOT A RESIDENT OF SUCH VILLAGE, PROVIDED THAT SUCH PERSON RESIDES IN THE COUNTY OF CAYUGA OR IN AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK. § 2. Section 3 of the public officers law is amended by adding a new subdivision 66 to read as follows: 66.
