BILL NUMBER: S5737 TITLE OF BILL : An act to amend the judiciary law, in relation to publication of official reports This measure is being introduced at the request of the Chief Administrative Judge on the recommendation of State Reporter{1}. This measure would amend provisions of the Judiciary Law to change the timetable for the bidding and award of the contract for publishing the Judiciary's Official Reports. The Official Reports include the published decisions of the Court of Appeals ("New York Reports"), the Appellate Divisions ("Appellate Division Reports") and the Supreme Court and other trial courts ("Miscellaneous Reports"). See Judiciary Law § 433-a. The measure is necessary to recognize the predominant role that technology now fills in the publication process. Under present law, contracts for publication of the Official Reports are let under the direction of the State Reporter (Judiciary Law § 434(2)) for periods of five years (id., § 434(7)). In each year preceding expiration of a contract, the State Reporter is required, at least once in June, July and August, to commence the bidding process

BONACIC -- (at request of the Office of Court Admin- istration) -- read twice and ordered printed, and when printed to be committed to the Committee on Judiciary AN ACT to amend the judiciary law, in relation to publication of offi- cial reports THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 3 and 4 of section 434 of the judiciary law, as amended by chapter 218 of the laws of 1985, are amended to read as follows: 3. In each year immediately preceding the expiration of the contract to be let as hereinafter provided, the state reporter shall give notice that a contract will be let for said printing and publication, together with a reference to this section, and that on or before the first day of [September] APRIL in such year, [he] THE STATE REPORTER will receive sealed proposals for such contract. Such notice shall be given [by publication thereof once in each of the first weeks of June, July and August, respectively, in a newspaper to be designated by the state reporter, published in each of the following cities, namely: New York, Albany, Rochester and Buffalo; such newspapers to be so designated as shall be most likely to give notice to the public of such letting; the expense of such publication to be paid by the state treasurer from the general funds of the state, after the same shall have been approved in writing by the state reporter and audited according to law] BEGINNING IN THE FIRST WEEK OF JANUARY IN THE PROCUREMENT OPPORTUNITIES NEWSLETTER PUBLISHED BY THE COMMISSIONER OF ECONOMIC DEVELOPMENT PURSUANT TO SECTION ONE HUNDRED FORTY-TWO OF THE ECONOMIC DEVELOPMENT LAW. 4. Said contract shall be let to the person who will publish and sell said reports and said combined official series, together with the weekly advance sheets thereof, and furnish the required copies to the various state and county officials, on terms deemed by said state reporter most EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
