                                 BILL NUMBER:  S5947

 TITLE OF BILL :  An act to amend the executive law, in relation to
requiring the transfer and appropriation, for the purpose of providing
class B technical uniforms for all investigators, senior investigators
and investigative specialists in the division of state police, a
portion of any unexpended moneys remaining in the state treasury at
the end of the 2017-2018 state fiscal year

 PURPOSE :

To provide for Class B technical uniforms for the New York State
Police Bureau of Investigation members.

 SUMMARY OF PROVISIONS :

Section 1: Establishes that effective April 1, 2018 their shall be
transferred any unexpended moneys to the Division of State Police for
the purpose of procuring class B technical uniforms for all
investigators, senior investigators and investigative specialists
within the division.

Section 2: Sets forth the effective date.

 JUSTIFICATION :

The New York State Police Bureau of Criminal Investigation (BCI) is
comprised of 1,130 Senior Investigators and Investigators. These
Investigators are assigned either to stations or to special details
throughout New York State.

Station Investigators investigate crimes that include Larcenies,
Robbery, Burglary, Identity Theft, Sex Crimes and Homicides.

Investigators assigned to special details carry out functions related
to Counter Terrorism, Forensic Investigations, Narcotics, Auto Theft,
Dignitary Protection, Special Investigations, Gaming and Computer
Crimes.

The station Investigators are required to dress in business style and
the Investigators assigned to the special details wear typical street
clothes to imitate the habits of people in the communities they are
working, in order to fit in. These types of clothing make it difficult
for the public to identify the BCI members as Law Enforcement
Officials.

There are many instances that the BCI members need to be identified as
State Police members. Search warrants, evidence field collection,
missing person/escaped prisoner searches and State of Emergencies when
declared are just a few examples. Being identified as State Police
members would raise the level of safety for the members when
confronted and would allow the public to easily identify a State
Police member when seeking help during an emergency.

It is estimated that in order to outfit the applicable personnel, an
appropriation of no less than $300,000 be made available to the
division.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 216 of the executive law is amended by adding a new
 subdivision 4 to read as follows:
   4. FOR THE STATE FISCAL YEAR  COMMENCING  APRIL  FIRST,  TWO  THOUSAND
 EIGHTEEN,  THERE SHALL BE TRANSFERRED FROM ANY UNEXPENDED MONEYS REMAIN-
 ING IN THE STATE TREASURY AT THE END OF THE TWO  THOUSAND  SEVENTEEN-TWO
 THOUSAND  EIGHTEEN STATE FISCAL YEAR, TO THE DIVISION OF STATE POLICE AN
 AMOUNT OF NOT LESS THAN THREE HUNDRED THOUSAND DOLLARS, AND SUCH  TRANS-
 FERRED  MONEYS  SHALL  BE  APPROPRIATED  AND EXPENDED FOR THE PURPOSE OF
 PROVIDING CLASS B  TECHNICAL  UNIFORMS  FOR  ALL  INVESTIGATORS,  SENIOR
 INVESTIGATORS AND INVESTIGATIVE SPECIALISTS IN THE DIVISION.
   § 2. This act shall take effect immediately.
