 Introduced  by  Sen.  AKSHAR -- read twice and ordered printed, and when
   printed to be committed to the Committee on Local Government
 
 AN ACT to legalize, validate, ratify and confirm certain actions of  the
   Candor  Fire  District  and  the  village  of Candor relating to their
   provision of fire protection services within the  territorial  bounda-
   ries of the village of Candor, and authorizing the creation of a joint
   fire district
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. All the acts done and proceedings heretofore and  hereafter
 had  and taken or caused to be had and taken by the Candor Fire District
 and the village of Candor, each within the town of Candor, by all  offi-
 cers,  employees or agents of said district and village beginning in the
 year 2007, where such acts and proceedings were and are consistent  with
 article  11 of the town law and article 10 of the village law, and where
 such acts and proceedings were and are consistent with such articles  or
 any  other  relevant  provision of law, are hereby legalized, validated,
 ratified and confirmed, notwithstanding any failure  or  defect  of  the
 Candor  Fire  District or village of Candor to comply with the procedure
 for creation of a joint fire district under former section 189-c of  the
 town  law  or any other relevant provision of law governing the creation
 of a joint fire district.
   § 2. Notwithstanding any contrary provisions of article 11 of the town
 law, article 17-a of the general municipal law, or  article  10  of  the
 village law, commencing upon the effective date of this act, the bounda-
 ry  of the Candor Fire District shall include the territorial boundaries
 of the village of Candor for the purposes of fire protection. The Candor
 Fire District shall continue to have  all  of  the  powers,  duties  and
 responsibilities  vested  in and imposed on town boards by article 11 of
 the town law, and shall be subject to all of the limitations, procedures
 and restrictions set forth in such article.
   § 3. This act shall take effect immediately.

 AN  ACT to legalize, validate, ratify and confirm certain actions of the
   Candor Fire District and the  village  of  Candor  relating  to  their
   provision  of  fire protection services within the territorial bounda-
   ries of the village of Candor, and authorizing the creation of a joint
   fire district
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Legislative  findings.  It is hereby found and determined
 that the Candor fire district, town of Candor  and  village  of  Candor,
 each  being  located  in Tioga County, have since 2007, acted consistent
 with all applicable provisions of article 11-A of the town law and arti-
 cle 22-A of the village  law  in  the  governance  of  the  Candor  fire
 district  providing  fire protection services to the town and village of
 Candor notwithstanding the failure of the town  of  Candor  to  properly
 hold hearings and adopt a resolution subject to permissive referendum as
 was required by law in establishment of a new joint fire district.
   §  2. The dissolution of the Candor fire district and the formation of
 a new joint Candor fire district covering the territorial boundaries  of
 the  town  of  Candor  and  the  village  of Candor, and all actions and
 proceedings taken in connection with such dissolution and formation,  to
 the  extent otherwise authorized by law, commencing on March 1, 2007 and
 prior to the effective date of this act are hereby legalized,  validated
 and  ratified, notwithstanding the town of Candor's failure to adhere to
 the provisions of the former sections 185 and 189-c of the town law that
 required the holding of hearings and adoption of a resolution subject to
