BILL NUMBER: S6338 TITLE OF BILL : An act alienating and substituting certain parklands in the city of Rome, county of Oneida PURPOSE : To alienate lands currently designated as parklands in the City of Rome. SUMMARY OF PROVISIONS : Sections 1 and 2 authorize the discontinuation of parkland use for the City of Rome while stipulating that said authorization should only take effect if the City dedicates land for usage as parkland or dedicates funding in an amount equal or greater than fair market value of the property towards capital improvements to existing parks. Section 3 sets forth the area to be alienated. Section 4 requires the City of Rome to follow federal requirements on the alienation and substitution of lands if the City receives funding from the Federal government for the alienated lands. Section 5 sets forth the effective date.

GRIFFO -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT alienating and substituting certain parklands in the city of Rome, county of Oneida THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subject to the provisions of this act, the city of Rome in the county of Oneida, acting by and through the city council, is hereby authorized to discontinue as parklands, the lands more particularly described in section three of this act. § 2. The authorization contained in section one of this act shall take effect only upon the condition that the city of Rome shall dedicate an amount equal or greater than the fair market value of the property being alienated in this act toward the acquisition of additional parklands and/or capital improvements to existing parklands. § 3. The parklands authorized by section one of this act to be discon- tinued as parklands are as follows: Parcel 1: That Piece or Parcel of land situate in the City of Rome, New York, known as Lot #6 of a tract of land on the Easterly side of the Rome - Oswego Road known as the Dunham Tract, as shown on a map of said tract made by George C. Schillner, C. E. and filed in the Oneida County Clerk's Office on October 3, 1919, which said Lot #6 is bounded and described as follows: Beginning at a point where the Easterly margin of Lot #6 intersects the center of the so called Oswego Road, being 874.75 feet Westerly from the Westerly rail of the main track of the Rome and Watertown and Ogdensburg Railroad, running thence South 9° 40' East along the Easterly margin of Lot #6, 524 feet to the Northerly blue line of the abandoned Erie Canal, thence Westerly along said blue line 225 feet to the South- easterly corner of Lot #7, Thence North 8° 45' West along the Easterly margin of said Lot #7, 452 feet to the Center of the Oswego Road, thence EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.

SUMMARY OF PROVISIONS : Sections 1 sets forth legislative authority to alienate parklands described in section 4 Section 2 sets forth City of Rome Council to authorize the discontinuation of waterfront parklands and other lands described in section 4. Section 3 sets forth the City of Rome to dedicate to an amount equal to or greater than the fair market value of the waterfront parkland being alienated toward acquisition of additional waterfront parklands and/or toward capital improvements to existing parklands and recreational facilities. Section 4 sets forth the area to be alienated.

Notwithstanding the failure of the city of Rome, county of Oneida, to seek and receive state legislative authorization to alienate the parklands described in section four of this act prior to such park- land being alienated, such alienation is hereby validated, legalized, ratified and confirmed. § 2. Subject to the provisions of this act, the city of Rome in the county of Oneida, acting by and through the city council, is hereby authorized to discontinue as waterfront parklands, the lands more particularly described in section four of this act. § 3. The authorization contained in section two of this act shall take effect only upon the condition that the city of Rome shall dedicate an amount equal to or greater than the fair market value of the waterfront parkland being alienated in this act toward the acquisition of addi- tional waterfront parklands and/or toward capital improvements to exist- ing parklands and recreational facilities. § 4. The parklands authorized by section two of this act to be discon- tinued as parklands are as follows: Beginning at a point of the Tract described by Metes and Bounds as follows: THENCE North 86°28'25" East, a distance of 74.63 Feet; THENCE North 79°42'25" East, a distance of 138.07 Feet; THENCE North 79°42'25" East, a distance of 223.58 Feet; EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
