 Introduced  by  Sen. HOYLMAN -- read twice and ordered printed, and when
   printed to be committed to the Committee on Environmental Conservation
 
 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   expanding  the  definition  of  "pesticide" to include seeds that have
   been coated or treated with an insecticide

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  35  of  section 33-0101 of the environmental
 conservation law, as added by chapter 685 of the laws of 1978 and renum-
 bered by chapter 612 of the laws of 1983, is amended to read as follows:
   35. "Pesticide" means:
   a. Any substance or mixture or  substances  intended  for  preventing,
 destroying, repelling, or mitigating any pest; [and]
   b.  Any substance or mixture of substances intended for use as a plant
 regulator, defoliant or desiccant; AND
   C. ANY SEEDS FOR PLANTING THAT HAVE BEEN COATED  OR  TREATED  WITH  AN
 INSECTICIDE.
   § 2. This act shall take effect immediately.
