BILL NUMBER: S6358 TITLE OF BILL : An act to amend the public health law, in relation to collaborative agreements to purchase, acquire, possess and operate automated external defibrillators; and to repeal subdivision 2 of section 3000-b of such law, relating thereto PURPOSE : Repeals provisions relating to collaborative agreements for the purchase, acquisition, possession and operation of automated external defibrillators. SUMMARY OF PROVISIONS : Section one amends paragraph (ii) of subdivision 2 of section 3000-a to the Public Health Law to retain existing Good Samaritan protections for collaborative agreements currently in place. Section two amends the definition of public access defibrillation provider under paragraph (c) of subdivision 1 of section 3000-b of the Public Health Law to remove "pursuant to a collaborative agreement under this section". HANNON -- read twice and ordered printed, and when printed to be committed to the Committee on Health AN ACT to amend the public health law, in relation to collaborative agreements to purchase, acquire, possess and operate automated external defibrillators; and to repeal subdivision 2 of section 3000-b of such law, relating thereto THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (ii) of subdivision 2 of section 3000-a of the public health law, as amended by chapter 373 of the laws of 2016, is amended to read as follows: (ii) an emergency health care provider under a collaborative agreement pursuant to THE FORMER SUBDIVISION TWO OF section three thousand-b of this article with respect to an automated external defibrillator, or § 2. Paragraph (c) of subdivision 1 of section 3000-b of the public health law, as added by chapter 552 of the laws of 1998, is amended to read as follows: (c) "Public access defibrillation provider" means a person, firm, organization or other entity possessing or operating an automated external defibrillator [pursuant to a collaborative agreement under this section]. § 3. Subdivision 2 of section 3000-b of the public health law is REPEALED. § 4. This act shall take effect immediately.
