BILL NUMBER: S6398 TITLE OF BILL : An act to amend the general municipal law, in relation to granting sick leave for officers and employees with a qualifying World Trade Center condition PURPOSE OR GENERAL IDEA OF BILL : This bill provides officers and employees who participated in the rescue, recovery or cleanup of the World Trade Center and subsequently developed a qualifying condition sick leave without loss of accrued sick leave. SUMMARY OF PROVISIONS : Section one of this bill amends the General Municipal Law to add a new section 92-d to provide officers and employees who participated in the rescue, recovery or cleanup of the World Trade Center and subsequently developed a qualifying condition shall receive line of duty sick leave. Section two of this bill provides that this act shall take effect on the ninetieth day after it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of

GOLDEN -- read twice and ordered printed, and when printed to be committed to the Committee on Local Government AN ACT to amend the general municipal law, in relation to granting sick leave for officers and employees with a qualifying World Trade Center condition THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The general municipal law is amended by adding a new section 92-d to read as follows: § 92-D. SICK LEAVE FOR OFFICERS AND EMPLOYEES WITH A QUALIFYING WORLD TRADE CENTER CONDITION. NOTWITHSTANDING ANY OTHER LAW, RULE OR REGU- LATION TO THE CONTRARY, OFFICERS AND EMPLOYEES OF ANY MUNICIPAL CORPO- RATION OR PUBLIC AUTHORITY OUTSIDE OF A CITY WITH A POPULATION OF ONE MILLION OR MORE WHO PREVIOUSLY FILED A NOTICE OF PARTICIPATION IN WORLD TRADE CENTER RESCUE, RECOVERY OR CLEANUP OPERATIONS AND SUBSEQUENTLY DEVELOP A QUALIFYING WORLD TRADE CENTER CONDITION, AS DEFINED IN SECTION TWO OF THE RETIREMENT AND SOCIAL SECURITY LAW, WHILE EMPLOYED WITH SUCH MUNICIPAL CORPORATION OR PUBLIC AUTHORITY SHALL BE GRANTED LINE OF DUTY SICK LEAVE. THE OFFICER OR EMPLOYEE SHALL BE COMPENSATED AT HIS OR HER REGULAR RATE OF PAY FOR THOSE REGULAR WORK HOURS DURING WHICH THE OFFI- CER OR EMPLOYEE IS ABSENT FROM WORK. SUCH LEAVE SHALL BE PROVIDED WITH- OUT LOSS OF AN OFFICER OR EMPLOYEE'S ACCRUED SICK LEAVE. § 2. This act shall take effect on the ninetieth day after it shall have become a law; provided, however, that effective immediately, the addition, amendment and/or repeal of any rule or regulation necessary for the implementation of this act on its effective date is authorized and directed to be made and completed on or before such effective date. SUMMARY OF PROVISIONS : Section one of this bill amends the General Municipal Law to add a new section 92-d to provide officers and employees of the State, a public authority or a municipality of less than one million people who participated in the World Trade Center rescue, recovery or cleanup activities and subsequently developed a qualifying condition with receive line of duty sick leave. An employee who switched employers after participating in the World Trade Center rescue, recovery or cleanup activities will still be eligible for the line of duty sick leave.
