 Introduced by Sens. AVELLA, ALCANTARA, CARLUCCI, HAMILTON, KLEIN, PERAL-
   TA, SAVINO, VALESKY -- read twice and ordered printed, and when print-
   ed to be committed to the Committee on Health
 
 AN ACT to direct the department of health to maintain funding, at levels
   equal to those available as of April 1, 2017, for services provided by
   family planning providers in the event of the reduction or elimination
   of federal funding therefor
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. In the event that the federal budget or  continuing  resol-
 utions  in force for federal fiscal year 2017  or 2018, or for both such
 federal fiscal years, or federal statutory or regulatory changes, reduce
 or eliminate federal funding for services, funded under Title X  of  the
 federal  Public Health Services Act as of December 31, 2016, the depart-
 ment of health shall continue to maintain funding  at  levels  equal  to
 those  available as of April 1, 2017, to ensure access to and the conti-
 nuity of services provided by family  planning  providers  that  receive
 funding under Title X of the federal Public Health Services Act.
   § 2. The commissioner of health is hereby authorized to promulgate any
 rules and regulations necessary to implement the provisions of this act.
   § 3. This act shall take effect immediately.
