BILL NUMBER: S6572 TITLE OF BILL : An act to amend chapter 589 of the laws of 2015 amending the insurance law relating to catastrophic or reinsurance coverage issued to certain small groups, in relation to the effectiveness thereof; to amend chapter 588 of the laws of 2015 amending the insurance law relating to catastrophic or reinsurance coverage issued to certain small groups, in relation to the effectiveness thereof; and in relation to directing the superintendent of financial services to add certain other health insurance matters to the assessment study of the impact of the prohibition on the sale of stop loss, catastrophic and reinsurance coverage to the small group market PURPOSE : The purpose of this bill is to allow stop loss, catastrophic and reinsurance coverages to remain in effect for certain self-funded small groups for one additional year. SUMMARY OF PROVISIONS : Sections 1 and 2 of the bill would allow for the continuation for an additional year of the sale of stop loss, catastrophic or reinsurance coverages, which were in effect on January 1, 2015, despite a general prohibition which would prevent insurers from selling this kind of

Section 5 of chapter 589 of the laws of 2015, amending the insurance law relating to catastrophic or reinsurance coverage issued to certain small groups, as amended by chapter 12 of the laws of 2016, is amended to read as follows: § 5. This act shall take effect on the same date and in the same manner as [a] chapter 588 of the laws of 2015 [amending the insurance law relating to catastrophic or reinsurance coverage issued to certain small groups, as proposed in legislative bills numbers S.5928-A and A.8134-A], takes effect [and shall be deemed repealed three years there- after]. § 2. Section 5 of chapter 588 of the laws of 2015, amending the insur- ance law relating to catastrophic or reinsurance coverage issued to certain small groups, as amended by chapter 12 of the laws of 2016, is amended to read as follows: § 5. This act shall take effect immediately; and shall be deemed repealed [3] 4 years after it shall have become a law. BILL NUMBER: S6572A TITLE OF BILL : An act to amend chapter 589 of the laws of 2015, amending the insurance law relating to catastrophic or reinsurance coverage issued to certain small groups, in relation to the effectiveness thereof; and to amend chapter 588 of the laws of 2015, amending the insurance law relating to catastrophic or reinsurance coverage issued to certain small groups, in relation to the effectiveness thereof PURPOSE : The purpose of this bill is to allow stop loss, catastrophic and reinsurance coverages to remain in effect for certain self-funded small groups for one additional year. SUMMARY OF PROVISIONS : Section one of the bill would extend for an additional year the provisions of chapter 589 of the laws of 2015, as amended by chapter 12 of the laws of 2016, which provided that small groups between the size of 51-100 who had reinsurance policies in effect on 1/1/2015 may continue to eligible to renew such policy or purchase re-insurance between 1/1/2016 and 1/1/2017 and renew such policy thereafter, and which also exempted municipal corporations with member employers with 100 or fewer employees from small group rating standards.
