BILL NUMBER: S6757 TITLE OF BILL : An act to authorize the North Bellmore Fire District to receive retroactive real property tax exempt status PURPOSE : To authorize North Bellmore Fire District to file an application with the Nassau County Assessor for a retroactive property tax exemption. SUMMARY OF PROVISIONS : Section one authorizes the Nassau County Assessor to accept an application from North Bellmore Fire District, for exemption from real property taxes pursuant to section 42C-a of the Real Property Tax Law for a portion of the 2015-2016 school and 2016 general tax roll, and all of the 2016-17 school and 2017 general tax roll for a parcel of land located in the town of Hempstead. Section two provides the effective date. JUSTIFICATION : The North Bellmore Fire District located at 815 Newbridge Road, North Bellmore, town of Hempstead acquired their property months prior to receiving tax-exempt status. BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to authorize the North Bellmore Fire District to receive retroac- tive real property tax exempt status THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Notwithstanding any other provision of law to the contrary, the assessor of the county of Nassau is hereby authorized to accept from the North Bellmore Fire District an application for exemption from real property taxes pursuant to section 420-a of the real property tax law, with respect to the 2015-2016 assessment roll for a portion of the 2015-2016 school taxes and all of the 2016 general taxes, for the parcel conveyed to such organization located at 815 Newbridge Road, North Bell- more, town of Hempstead, county of Nassau, otherwise known as Nassau county parcel ID section 51 block 75 lot 54. If accepted, the applica- tion shall be reviewed as if it had been received on or before the taxa- ble status date established for such roll. If satisfied that such organization would otherwise be entitled to such exemption if such organization had filed an application for exemption by the appropriate taxable status date, the assessor, upon approval by the Nassau county legislature, may make appropriate correction to the subject rolls. If such exemption is granted and such organization, therefore, shall have paid any tax with respect to the subject rolls, the applicable governing body or tax department may, in its sole discretion, provide for the refund of those taxes paid and cancel those taxes, fines, penalties, liens or interest remaining unpaid. § 2.
