BILL NUMBER: S6863 TITLE OF BILL : An act to amend the tax law, in relation to establishing a credit for customers of private water utilities PURPOSE : This legislation would establish a private water utility bill relief credit. SUMMARY OF PROVISIONS : Section 606 of the tax law is amended by adding a new subsection ccc to establish private a water utility bill relief credit. An individual taxpayer who is serviced by a private water utility shall be allowed a credit against their tax equal to the amount of such taxpayer's annual water bill ascribable to property taxes paid by their private water utility. Section 2 requires the Commissioner of the New York State Tax Department to determine the procedure for certification for such credit.

MARCELLINO -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the tax law, in relation to establishing a credit for customers of private water utilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 606 of the tax law is amended by adding a new subsection (ccc) to read as follows: (CCC) PRIVATE WATER UTILITY BILL RELIEF CREDIT. (1) GENERAL. AN INDI- VIDUAL TAXPAYER WHO IS SERVICED BY A PRIVATE WATER UTILITY SHALL BE ALLOWED A CREDIT AGAINST THE TAX IMPOSED BY THIS ARTICLE EQUAL TO THE AMOUNT OF SUCH TAXPAYER'S ANNUAL WATER BILL ASCRIBABLE TO PROPERTY TAXES PAID BY SUCH PRIVATE WATER UTILITY. (2) CERTIFICATION FOR CREDIT ALLOWANCE. THE COMMISSIONER SHALL DETER- MINE THE PROCEDURE FOR CERTIFICATION FOR THE CREDIT AUTHORIZED PURSUANT TO THIS SUBSECTION. § 2. This act shall take effect immediately and shall apply to taxable years beginning on and after the first of January next succeeding the date on which it shall have become a law. (2) CERTIFICATION FOR CREDIT ALLOWANCE. THE COMMISSIONER SHALL DETER- MINE THE PROCEDURE FOR CERTIFICATION FOR THE CREDIT AUTHORIZED PURSUANT TO THIS SUBSECTION. § 2. The public service commission, in conjunction with affected municipal corporations located in the county of Nassau, shall conduct a feasibility study of the practicality of Jericho Water District, located in the town of Oyster Bay, supplying water to any current customers of American Water services.
