BILL NUMBER: S6922 SPONSOR: GALLIVAN TITLE OF BILL: An act to amend the real property tax law, in relation to the equalization in school districts located in more than one city or town PURPOSE: To provide real property owners the peace of mind of knowing that the tax levy percentage voted on as part of a school budget is the same used to calculate the school tax levy owed by a property owner on September 1st of each year. SUMMARY OF PROVISIONS: Section 1 amends section 1314 governing the equalization in school districts located in more than one city or town. Section 2 of the bill provides the effective date.

GALLIVAN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the real property tax law, in relation to the equaliza- tion in school districts located in more than one city or town THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (d) of subdivision 1 of section 1314 of the real property tax law, as amended by chapter 158 of the laws of 2002, is amended to read as follows: (d) Such district superintendent shall also determine what proportion of any tax to be levied in such school district for school purposes during the current school year shall be levied upon each part of a city or town included in such school district by dividing the sum of the full valuation of real property in such part of a city or town by the total of all such full valuations of real property in such school district. Such proportions shall be expressed in the nearest exact ten thousandths and the school authorities of such school district shall levy such a proportion of any tax to be raised in the school district during the current school year upon each part of a city or town included in such school district as shall have been determined by the district super- intendent. A new proportion shall be determined for each school year thereafter by the district superintendent in accordance with the provisions of this section by the use of the [latest] CURRENT state equalization rates THEN IN EFFECT. In any such school district that is not within the jurisdiction of a district superintendent of schools, the duties which would otherwise be performed by the district superintendent under the provisions of this section, shall be performed by the school authorities of such district. § 2. This act shall take effect on the first of January next succeed- ing the date on which it shall have become a law.
