TITLE OF BILL:  An act to amend a chapter of the laws of 2017, relat-
ing to requiring the office for people with developmental disabilities
to establish the care demonstration program, as proposed in legislative
bills numbers S. 5681 and A. 7399-A, in relation to the services
provided, the monitoring of such program and the effectiveness thereof;
and providing for the repeal of certain provisions of such chapter
relating thereto

 
PURPOSE:

This bill would codify OPWDD care demonstration programs to ensure
community based services continue to be offered to those with a develop-
mental disability through March 31, 2020.

 
SUMMARY OF PROVISIONS:

Section 1 repeals section 2 of chapter 491 of the laws of 2017.

Section 2 amends sections 1, 3, and 4 of chapter 491 of the laws of 2017
to make technical amendments and provide that the act shall expire and
be deemed repealed on March 31, 2020.

Section 3 provides that the act shall take effect on the same date and
in the same manner as chapter 491 of the laws of 2017.

 
EXISTING LAW:

Chapter 50 of the laws of 2017 (State Ops Budget Bill) provides $840,000
in funding for pilot programs with state employees during SFY 2017-18 in
support of community-based care opportunities.

 
JUSTIFICATION:

This legislation would codify existing state programs. Currently, OPWDD
has state employees offer certain community based programs to the devel-
opmentally disabled. These programs have proven successful and have a
waiting list. These services provide critical supports to individuals
who may not need residential care but are still in need of services. By
codifying this program, the state will be making a commitment for ensur-
ing these services continued to be offered.

 
LEGISLATIVE HISTORY:

Negotiated chapter amendment to chapter 491 of the laws of 2017.

 
FISCAL IMPLICATIONS:

$840,000 was appropriated for these programs in the FY2017-18 State
Budget.

 
LOCAL FISCAL IMPLICATIONS:

None.

 
EFFECTIVE DATE:
This act shall take effect immediately and shall expire and be deemed
repealed on March 31, 2020.

 AN ACT to amend a chapter of the laws of 2017, relating to requiring the
   office for people with developmental  disabilities  to  establish  the
   care  demonstration  program, as proposed in legislative bills numbers
   S. 5681 and A. 7399-A, in relation to the services provided, the moni-
   toring of such program and the effectiveness  thereof;  and  providing
   for the repeal of certain provisions of such chapter relating thereto
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 2 of a chapter of the laws  of  2017,  relating  to
 requiring  the  office  for  people  with  developmental disabilities to
 establish the care demonstration program,  as  proposed  in  legislative
 bills numbers S. 5681 and A. 7399-A is REPEALED.
   § 2. Sections 1, 3 and 4 of a chapter of the laws of 2017, relating to
 requiring  the  office  for  people  with  developmental disabilities to
 establish the care demonstration program,  as  proposed  in  legislative
 bills numbers S. 5681 and A. 7399-A, are amended to read as follows:
   Section 1. (a) The commissioner of the office for people with develop-
 mental  disabilities  shall establish the care demonstration program, to
 utilize the state workforce to provide community based care to  individ-
 uals with developmental disabilities.
   (b)  The  services  provided  by these pilots [shall] MAY include, but
 shall not be limited to:
   (i) community habilitation;
   (ii) in-home respite;
   (iii) pathways to employment;
   (iv) supported employment (SEMP); and
   (v) community prevocational services.
   § [3] 2. The commissioner of the office for people  with  disabilities
 shall  promulgate  all  rules and regulations necessary to implement the
 provisions of this section.
   § [4] 3. This act shall take effect immediately and shall  expire  and
 be  deemed  repealed  March  31, [2021] 2020; provided however, that all

 rules and regulations necessary for the implementation of this act shall
 have been promulgated prior to such effective date.
   §  3.  This  act  shall  take  effect on the same date and in the same
 manner as a chapter of the laws  of  2017,  relating  to  requiring  the
 office  for people with developmental disabilities to establish the care
 demonstration program, as proposed in legislative bills numbers S.  5681
 and A. 7399-A, takes effect.
