BILL NUMBER: S7777 SPONSOR: LAVALLE TITLE OF BILL: An act to amend the general municipal law, in relation to creating the town of Southampton community development agency PURPOSE: Establishes the Town of Southampton Community Development Agency SUMMARY OF PROVISIONS: Article 15-B of the General Municipal law is amended by adding a new title 11B establishing the Town of Southampton Community Development Agency. JUSTIFICATION: The Town of Southampton would like to re-establish the Southampton Community Development Agency whose statuary authorization was repealed

THIELE -- read once and referred to the Committee on Local Governments AN ACT to amend the general municipal law, in relation to creating the town of Southampton community development agency THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Article 15-B of the general municipal law, is amended by adding a new title 118 to read as follows: TITLE 118 TOWN OF SOUTHAMPTON COMMUNITY DEVELOPMENT AGENCY SECTION 680-E. TOWN OF SOUTHAMPTON COMMUNITY DEVELOPMENT AGENCY. § 680-E. TOWN OF SOUTHAMPTON COMMUNITY DEVELOPMENT AGENCY. FOR THE BENEFIT OF THE TOWN OF SOUTHAMPTON AND THE INHABITANTS THEREOF, A COMMU- NITY DEVELOPMENT AGENCY, TO BE KNOWN AS THE TOWN OF SOUTHAMPTON COMMUNI- TY DEVELOPMENT AGENCY, IS HEREBY ESTABLISHED FOR THE ACCOMPLISHMENT OF ANY OR ALL OF THE PURPOSES SPECIFIED IN ARTICLES FIFTEEN AND FIFTEEN-A OF THIS CHAPTER. IT SHALL CONSTITUTE A BODY CORPORATE AND POLITIC, AND BE PERPETUAL IN DURATION. IT SHALL HAVE THE POWERS AND DUTIES NOW OR HEREAFTER CONFERRED BY ARTICLES FIFTEEN AND FIFTEEN-A OF THIS CHAPTER UPON COMMUNITY DEVELOPMENT AGENCIES AND PROVIDED THAT THE EXERCISE OF THE POWERS BY SUCH AGENCY WITH RESPECT TO THE ACQUISITION OF REAL PROP- ERTY WHETHER BY PURCHASE, CONDEMNATION OR OTHERWISE, SHALL BE LIMITED TO THE CORPORATE LIMITS OF THE TOWN OF SOUTHAMPTON, AND SUCH AGENCY SHALL TAKE INTO CONSIDERATION THE LOCAL ZONING AND PLANNING REGULATIONS AS WELL AS THE REGIONAL AND LOCAL COMPREHENSIVE LAND USE PLANS. IT SHALL BE ORGANIZED IN A MANNER PRESCRIBED BY AND BE SUBJECT TO THE PROVISIONS OF ARTICLES FIFTEEN AND FIFTEEN-A OF THIS CHAPTER. ITS MEMBERS SHALL CONSIST OF THE SUPERVISOR OF THE TOWN OF SOUTHAMPTON, WHO SHALL BE ITS CHAIRPERSON AND THE FOUR COUNCILMEN OR COUNCILWOMEN OF THE TOWN OF SOUTHAMPTON. THE AGENCY, ITS MEMBERS, OFFICERS AND EMPLOYEES AND ITS OPERATIONS AND ACTIVITIES SHALL IN ALL RESPECTS BE GOVERNED BY THE PROVISIONS OF ARTICLES FIFTEEN AND FIFTEEN-A OF THIS CHAPTER.
