 Introduced  by  Sen. HELMING -- read twice and ordered printed, and when
   printed to be committed to the Committee on Judiciary
 
 AN ACT to authorize the town justice court of the town of Canandaigua to
   hold justice court in the city of Canandaigua
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section  1.  Notwithstanding any provision of law to the contrary, any
 justice of the town of Canandaigua may hold all  court  proceedings  and
 perform  any  function or official act within his or her jurisdiction in
 the city of Canandaigua; provided that such proceedings are  held  in  a
 courtroom  or  other  suitable facility open to the public, and provided
 further that the town board of Canandaigua has authorized such extrater-
 ritorial proceedings.
   § 2. This act shall take effect immediately.

 Introduced  by  Sen. HELMING -- read twice and ordered printed, and when
   printed to be committed to the  Committee  on  Judiciary  --  reported
   favorably  from  said  committee,  ordered to first and second report,
   ordered to a third reading, amended and ordered  reprinted,  retaining
   its place in the order of third reading

 AN  ACT  to  amend  the  uniform  justice  court act, in relation to the
   location of holding town court proceedings of the town of Canandaigua
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 106 of the uniform justice court act is amended by
 adding a new subdivision 11 to read as follows:
   11. NOTWITHSTANDING THE PROVISIONS OF SUBDIVISION ONE OF THIS SECTION,
 THE TOWN OF CANANDAIGUA, IN THE COUNTY OF ONTARIO,  MAY  HOLD  ALL  TOWN
 COURT  PROCEEDINGS  IN  THE  CITY  OF  CANANDAIGUA,  PROVIDED  THAT SUCH
 PROCEEDINGS ARE HELD IN A COURTROOM OR OTHER SUITABLE FACILITY  OPEN  TO
 THE  PUBLIC AND THE TOWN BOARD OF CANANDAIGUA HAS AUTHORIZED SUCH EXTRA-
 TERRITORIAL PROCEEDINGS.
   § 2. This act shall take effect immediately.
