TITLE OF BILL:

An act to amend the public officers law, in relation to authorizing a
person holding the office of assistant district attorney in the county
of Oswego to reside in an adjoining county within the state

 
PURPOSE:

This bill amends section three of the public officers law, by adding a
new subdivision 67 which authorizes a person to hold the office of
assistant district attorney in the county of Oswego to reside in an
adjoining county within the state.

 
SUMMARY OF PROVISIONS:

Section 1. Amends Section three of the public officers law, which
requires a person to be a resident of the political subdivision or
municipal corporation of the state for which he or she shall be chosen

or within which his or her official functions are required to be exer-
cised by adding a new subdivision 67 which would allow a person to hold
the office of assistant district attorney of the county of Oswego
provided that person reside in Oswego County or in an adjoining county
within the State of New York. This authorization does not extend to the
first assistant district attorney.

Section 2. This act shall take effect immediately.

 
JUSTIFICATION:

The office of the Assistant District Attorney is a critical position in
the Oswego County District Attorney's office. According to the District
Attorney and local County Officials, they have experienced difficulty in
recruiting qualified individuals to fill vacancies for the office of
assistant district attorney. This legislation would authorize Oswego
County to hire Assistant District Attorneys not only from Oswego County
but also from adjoining counties in New York State.

 AN ACT to amend the public officers law, in relation  to  authorizing  a
   person holding the office of assistant district attorney in the county
   of Oswego to reside in an adjoining county within the state

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 3 of the public officers law is amended by adding a
 new subdivision 67 to read as follows:
   67. IN THE COUNTY OF OSWEGO, THE PROVISIONS OF THIS  SECTION,  OR  ANY
 OTHER PROVISION OF LAW, REQUIRING A PERSON TO BE A RESIDENT OF THE POLI-
 TICAL  SUBDIVISION OR MUNICIPAL CORPORATION OF THE STATE FOR WHICH HE OR
 SHE SHALL BE CHOSEN OR WITHIN WHICH HIS OR HER  OFFICIAL  FUNCTIONS  ARE
 REQUIRED  TO  BE  EXERCISED, SHALL NOT PREVENT A PERSON FROM HOLDING THE
 OFFICE OF ASSISTANT DISTRICT ATTORNEY OF THE  COUNTY  OF  OSWEGO,  OTHER
 THAN  THE  FIRST  ASSISTANT DISTRICT ATTORNEY, PROVIDED THAT SUCH PERSON
 RESIDES IN OSWEGO COUNTY OR IN AN ADJOINING COUNTY WITHIN THE  STATE  OF
 NEW YORK.

PURPOSE:

This bill amends section three of the public officers law, by adding a
new subdivision 67 which authorizes a person to hold the office of
assistant district attorney in the county of Oswego to reside in an
adjoining county within the state.

 
SUMMARY OF PROVISIONS:

Section 1. Amends Section three of the public officers law, which
requires a person to be a resident of the political subdivision or
municipal corporation of the state for which he or she shall be chosen

or within which his or her official functions are required to be exer-
cised by adding a new subdivision 67 which would allow a person to hold
the office of assistant district attorney of the county of Oswego
provided that person reside in Oswego. County or in an adjoining county
within the State of New York. This authorization does not extend to the
first assistant district attorney or the chief assistant district attor-
ney, which would assume the responsibility of the district attorney in
the district attorney's absence from the county or inability to perform
his or her duties. Assistant district attorneys in other counties in the
state must still reside in the county they serve unless otherwise
provided by law.

Section 2. This act shall take effect immediately.

 IN  AN ADJOINING COUNTY WITHIN THE STATE OF NEW YORK; PROVIDED, HOWEVER,
 THAT ANY PERSON PERFORMING SUCH  FUNCTIONS  OR  HOLDING  THE  OFFICE  OF
 ASSISTANT  DISTRICT  ATTORNEY IN ANY OTHER COUNTY SHALL BE A RESIDENT OF
 SUCH COUNTY UNLESS OTHERWISE PROVIDED BY LAW.  THE  PROVISIONS  OF  THIS
 SUBDIVISION  SHALL  NOT  APPLY TO ANY PERSON HOLDING THE OFFICE OF FIRST
 ASSISTANT DISTRICT ATTORNEY OR CHIEF ASSISTANT  DISTRICT  ATTORNEY,  THE
 HOLDER  OF  WHICH  WOULD ASSUME THE DUTIES OF THE DISTRICT ATTORNEY UPON
 THE DISTRICT ATTORNEY'S ABSENCE FROM THE COUNTY  OR  UPON  THE  DISTRICT
 ATTORNEY'S INABILITY TO PERFORM HIS OR HER DUTIES.
   § 2. This act shall take effect immediately.
