TITLE OF BILL:

An act to create a task force to review the affordable housing lotteries
within the state; and providing for the repeal of such provisions upon
expiration thereof

 
PURPOSE:

To assess the current methods used in affordable housing lotteries to
maintain efficiency and prevent a crisis in the affordable housing
lotteries.

 
SUMMARY OF PROVISIONS:

Section 1. (a) There is hereby created within the division of housing
and community renewal a temporary task force to examine the effective-
ness of lotteries and recommend improvements.

Section 1. (b) The task force shall utilize information collected from
organizations, programs and agencies throughout the state to make its
recommendations.

Section 1. (c) The task force shall be made up representatives who have
used and worked for housing lotteries, housing experts and represen-
tatives from relevant agencies. In addition, the members of the task
force shall receive no compensation for their services but shall be
reimbursed for expenses.

Section 1. (d) No later than one year after the effective date of this
section, the task force shall provide a report to the temporary presi-
dent of the senate, the minority leader of the senate, the speaker of
the assembly, the minority leader of the assembly, and the chairman of
the Assembly and Senate committees.

 
EXISTING LAW:

Under current law, New York does not have a specific task force to
review affordable housing lotteries.

 
JUSTIFICATION:

The issue of housing lotteries and the challenges applicants face is
particularly important because of the uneven experiences constituents
have shared. Applicants have reported problems with the application
system that can prove frustrating, deeply discouraging, and cause them
to give up on the process even after having "won" the housing lottery.
Some applicants face the obstacles of repeated requests to submit the
same documents, insufficient explanations, or being left uninformed as
to where they are in the process. There is the concern that the
complaints, we as elected officials receive, represent a part of larger,
systematic problems within the housing lottery process. I believe the
thorough, independent assessment can provide can contribute to a process
that meets the needs of New Yorkers.

As you know, housing lotteries represent an important, if limited, tool
for preserving the diversity of communities across our State.  New York-
ers benefit when we use this tool to its fullest extent, especially when
considering the current affordable housing crisis from Montauk to
Buffalo.

This act shall take effect immediately; provided however that this act

 AN ACT to create a task force to review the affordable housing lotteries
   within the state; and providing for the repeal of such provisions upon
   expiration thereof
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. (a) There is hereby created within the division of housing
 and community renewal a  temporary  task  force  on  affordable  housing
 lotteries  which,  pursuant  to  the  provisions  of this section, shall
 review the affordable housing lotteries within New York state and deter-
 mine the lotteries' effectiveness and recommend how the lotteries  could
 be improved.
   (b)  The task force shall utilize information collected from organiza-
 tions, programs and agencies both in New York city  and  throughout  the
 state to make its recommendations.
   (c)(i) The members of the task force shall include the commissioner of
 the division of housing and community renewal or his or her designee; at
 least  two  representatives  of tenants who have used affordable housing
 lotteries within New York  state;  at  least  two  representatives  from
 affordable  housing lotteries within New York state; at least one expert
 on affordable housing  lotteries;  and  any  other  relevant  agency  or
 participant that is deemed appropriate. The commissioner of the division
 of  housing and community renewal or his or her designee shall be desig-
 nated as the chairperson of such task force and  shall  select  a  vice-
 chairperson and a secretary.
   (ii)  The  members of the task force shall receive no compensation for
 their services but shall be reimbursed for expenses actually and  neces-
 sarily incurred in the performance of their duties.
   (d)  No  later than one year after the effective date of this section,
 the task force shall provide a report to the temporary president of  the
 senate,  the minority leader of the senate, the speaker of the assembly,
 the minority leader of the assembly, the chair of  the  senate  housing,
 construction  and  community  development committee and the chair of the

 assembly housing committee. Such report shall include, but not be limit-
 ed to, the effectiveness of affordable housing lotteries within New York
 state, how the lotteries can be improved, and  recommendations  for  any
 other program or policy initiative the task force deems appropriate. The
 report shall be posted on the websites of the appropriate agencies.
   §  2.  This  act  shall take effect immediately; provided however that
 this act shall expire and be deemed repealed 2 years after such date.
