TITLE OF BILL:

An act to direct the department of environmental conservation to adopt
rules and regulations requiring permitees to place air monitoring equip-
ment near permitted waste transfer stations

 
PURPOSE OR GENERAL IDEA OF BILL:

To require the placement and operation air quality monitoring systems
near waste transfer stations in New York State

 
SUMMARY OF PROVISIONS:

Section one requires the Commissioner of the Department of Environmental
Conservation (NYSDEC) to adopt rules and regulations requiring permit-
tees to place air monitoring equipment at an appropriate distance from
waste transfer stations.

              

Section two is the effective clause.

 
JUSTIFICATION:

A new marine waste transfer station was cited on the Upper East Side of
Manhattan. The waste transfer station sits in a highly residential area
in close proximity to athletic fields, public schools, the ferry land-
ing, and senior and public housing.

Increased emissions through idling trucks, boat discharge and the opera-
tion of the transfer station has the ability to negatively aggravate the
air quality in the Upper East Side.

According to the NYC Department of Environmental Conservation, the Upper
East Side already experiences high levels of air pollution.  Research
has shown that air pollution can worsen asthma symptoms.  By requiring
constant air monitoring and consultation with local elected officials
and stakeholders, city residents would be provided with accurate infor-
mation on the occurrence of air pollution and show the success or fail-
ure of pollution-reduction efforts.

This bill not only monitors the air quality of the waste transfer
station in the Upper East Side but off all waste transfer stations in
New York City.
