S T A T E O F N E W Y O R K ________________________________________________________________________ 10793 I N A S S E M B L Y July 10, 2020 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Glick) -- read once and referred to the Committee on Higher Education AN ACT to amend the education law, in relation to the issuance of certificate of residence forms to individuals desiring to enroll in community colleges as non-resident students THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 2 of section 6222 of the education law, as added by chapter 305 of the laws of 1979, is amended to read as follows: 2. (A) The methods and procedures for the admission of such non-resi- dent students to the city university of New York community colleges shall be in accordance with the provisions of section sixty-three hundred five of this [chapter] TITLE. Notwithstanding any inconsistent provision of law, any reference contained in such section sixty-three hundred five to the state university trustees or to the chancellor of the state university of New York shall, for the purposes of this section, be deemed to mean and refer to the board of trustees and the chancellor of the city university of New York, respectively. (B) PROVIDED, FURTHER, IN ACCORDANCE WITH SECTION SIX THOUSAND THREE HUNDRED FIVE OF THIS TITLE, THE CHIEF FISCAL OFFICER OF EACH COUNTY, AS DEFINED IN SECTION 2.00 OF THE LOCAL FINANCE LAW, SHALL, UPON APPLICA- TION AND SUBMISSION TO HIM OF SATISFACTORY EVIDENCE, ISSUE TO ANY PERSON DESIRING TO ENROLL IN A COMMUNITY COLLEGE AS A NON-RESIDENT STUDENT, A CERTIFICATE OF RESIDENCE FORM SHOWING THAT SAID PERSON IS A RESIDENT OF SAID COUNTY. IF THE CHIEF FISCAL OFFICER OF A COUNTY REFUSES TO ISSUE SUCH A CERTIFICATE ON THE GROUND THAT THE PERSON APPLYING THEREFOR IS NOT A RESIDENT OF SUCH COUNTY, THE PERSON APPLYING MAY APPEAL TO THE CHANCELLOR OF THE CITY UNIVERSITY. THE CHANCELLOR OF THE CITY UNIVERSITY SHALL MAKE A DETERMINATION AFTER A HEARING, UPON TEN DAYS' NOTICE TO SUCH CHIEF FISCAL OFFICER OF THE COUNTY, AND SUCH DETERMINATION SHALL BE FINAL AND BINDING ON THE COUNTY. SUCH PERSON SHALL, UPON HIS REGISTRA- TION FOR EACH COLLEGE YEAR, FILE WITH THE COLLEGE SUCH A CERTIFICATE OF RESIDENCE FORM ISSUED NOT EARLIER THAN TWO MONTHS PRIOR THERETO, AND SUCH CERTIFICATE OF RESIDENCE FORM SHALL BE VALID FOR A PERIOD OF ONE YEAR FROM THE DATE OF ISSUANCE. § 2. This act shall take effect immediately.
