 AN ACT to amend the education law, in relation to the request by parents
   for translated documents for students with disabilities

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  4403 of the education law is amended by adding a
 new subdivision 22 to read as follows:
   22. TO PROVIDE ANY PARENT  OR  PERSON  IN  PARENTAL  RELATION  WITH  A
 STUDENT  WITH  A  DISABILITY  AS  DEFINED PURSUANT TO SUBDIVISION ONE OF
 SECTION FORTY-FOUR HUNDRED ONE OF THIS ARTICLE, ALL  EVALUATIONS,  INDI-
 VIDUALIZED  EDUCATION  PROGRAMS,  AND RELATED DOCUMENTS NECESSARY TO THE
 IMPLEMENTATION OF SUCH  INDIVIDUALIZED  EDUCATION  PROGRAMS,  TRANSLATED
 INTO  THEIR PRIMARY LANGUAGE AT THE REQUEST OF SUCH PARENT, OR PERSON IN
 PARENTAL RELATION, TO THE EXTENT FEASIBLE.  SUCH  PARENT  OR  PERSON  IN
 PARENTAL  RELATION  MUST  COMPLETE  AND SUBMIT A FORM TO THE DEPARTMENT,
 PROVIDED BY THE  DEPARTMENT,  WHICH  SHALL  RELEASE  SUCH  DOCUMENTS  IN
 COMPLIANCE  WITH  APPLICABLE  STATE  AND  FEDERAL  PRIVACY  LAWS FOR THE
 PURPOSES OF TRANSLATIONS. SUCH FORMS SHALL BE ISSUED BY  THE  DEPARTMENT
 AND  MADE AVAILABLE TO SCHOOLS UPON REQUEST AND PUBLISHED ON THE DEPART-
 MENT'S WEBSITE.  TRANSLATION OF DOCUMENTS SHALL NOT IMPEDE THE IMPLEMEN-
 TATION  OF  A  STUDENT'S  INDIVIDUALIZED  EDUCATION  PROGRAM  OR   OTHER
 SERVICES.  NO  SCHOOL  DISTRICT  SHALL  BE LIABLE FOR THE FAILURE OF THE
 DEPARTMENT TO PROVIDE AN ACCURATE TRANSLATION.
   § 2. This act shall take effect immediately.
