   tee on Tourism, Parks, Arts and Sports Development
 
 AN ACT to amend the parks, recreation and historic preservation law  and
   the  general  municipal  law, in relation to farmers' markets in state
   and local parks

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 3.09 of the parks, recreation and historic preser-
 vation law, is amended by  adding  a  new  subdivision  24  to  read  as
 follows:
   24.  PERMIT  FARMERS'  MARKETS  WHICH  OFFER  FOR  SALE  FARM AND FOOD
 PRODUCTS, AS SUCH TERMS ARE DEFINED IN SECTION TWO HUNDRED SIXTY OF  THE
 AGRICULTURE  AND  MARKETS  LAW, AT STATE PARKS WHEN SUCH FARMERS' MARKET
 DOES NOT HARM THE NATURAL ENVIRONMENT OR INTEGRITY OF THE PARK.
   § 2. Section 72-p of the general municipal law, as  added  by  chapter
 506  of  the  laws  of 1989, is amended by adding a new subdivision 4 to
 read as follows:
   4. SUCH MUNICIPAL CORPORATION MAY PERMIT FARMERS' MARKETS WHICH  OFFER
 FOR  SALE  FARM  AND FOOD PRODUCTS, AS SUCH TERMS ARE DEFINED IN SECTION
 TWO HUNDRED SIXTY OF THE AGRICULTURE AND MARKETS LAW, IN ANY  PARK  OVER
 WHICH  SUCH  CORPORATION HAS JURISDICTION;  PROVIDED, HOWEVER, THAT SUCH
 FARMERS' MARKET DOES NOT UNDULY BURDEN NEARBY  RESIDENTS  AND  DOES  NOT
 HARM THE NATURAL ENVIRONMENT OR INTEGRITY OF THE PARK.
   § 3. This act shall take effect immediately.
