 AN  ACT to amend the public health law, in relation to the establishment
   of obstetric hemorrhage protocols
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Paragraph  (c)  of subdivision 1 of section 2803-n of the
 public health law, as added by a chapter of the laws of  2019,  amending
 the  public health law relating to the establishment of obstetric hemor-
 rhage protocols, as proposed in legislative bills numbers S. 4498-A  and
 A.    6962-A,  is  amended  and  a new subdivision 3 is added to read as
 follows:
   (c) (i) [The commissioner  shall  provide  guidance  to  hospitals  on
 obstetric  hemorrhage  protocols, in consultation with clinical experts,
 and develop or identify an  existing  toolkit  on  obstetric  hemorrhage
 management,  which  may  include a hemorrhage care checklist  for use by
 hospitals as part of the protocols and guidance on simulation  training.
 The  commissioner  shall report to the temporary president of the senate
 and the speaker of the assembly on data reported to the department under
 this paragraph within two years from the effective date  of  this  para-
 graph, and every two years thereafter.
   (ii)]  The  hospital shall adopt, implement[,] AND periodically update
 [and submit to the department]  standard  protocols  for  management  of
 obstetric hemorrhage. Such protocols shall address early recognition and
 assessment[,]  AND  readiness to respond in a multidisciplinary manner[,
 and data reporting to the department sufficient for  the  department  to
 monitor  and  report  pursuant  to this paragraph]. Such protocols shall
 utilize risk assessment tools such as the toolkit established or identi-
 fied by the department under [this paragraph] SUBDIVISION THREE OF  THIS
 SECTION  and  shall include a response plan providing for the triage and
 transfer to higher level facilities if needed.
   (II) THE HOSPITAL SHALL MAINTAIN AND FURNISH PROTOCOLS FOR  MANAGEMENT
 OF  OBSTETRIC  HEMORRHAGE  REQUIRED PURSUANT TO SUBPARAGRAPH (I) OF THIS
 PARAGRAPH TO THE DEPARTMENT, IMMEDIATELY UPON REQUEST.
