BILL NUMBER: S1550 SPONSOR: KENNEDY TITLE OF BILL: An act to amend the highway law, in relation to designating South Park Avenue in the city of Lackawanna as a state highway PURPOSE: Enactment of this legislation would designate South Park Avenue in the City of Lackawanna as a state highway, thereby relieving the city of the costs and effort associated with the care and maintenance of such road. SUMMARY OF PROVISIONS: Section 1 amends paragraph 1 of subdivision 14 of section 341 of the highway law, as amended by chapter 639 of the laws of 1987, to include the portion of South Park A venue beginning at the town line of the City of Buffalo south nine thousand nine hundred twenty feet to the southern city line of the City of Lackawanna.
EXISTING LAW: Under existing law, the portion of South Park Avenue that lies within the City of Lackawanna must be plowed and maintained by the city, as it is not considered to be a state highway for such purposes. JUSTIFICATION: The City of Lackawanna is currently facing very serious financial prob- lems, due to a shrinking tax base and rising costs. Although city lead- ers have done a great deal to increase revenues, they are nonetheless faced with mounting costs, such as road repair, maintenance and snow- plowing. Under New York's highway law, highways and roadways lying with- in city limits fall under the jurisdiction of said city, while state highways and state roadways fall under the jurisdiction of the state. The NYS Department of Transportation plows and maintains South Park Avenue outside of the city limits, and this legislation would include an additional 9,920 feet of South Park Avenue under NYS DOT jurisdiction, thereby relieving the City of Lackawanna of the costs associated with the care of this roadway.
