TITLE OF BILL:

An act approving land transactions relating to the implementation of the
land exchange for the forest preserve health and safety land account and
public utility improvements

 
PURPOSE:

This bill relates to the classification of historical lands and build-
ings located within the forest preserve.

 
SUMMARY OF PROVISIONS:

Section 1 adds a new subdivision 3 of section 816 of the executive law
to include any lands or buildings located within the forest preserve
that are listed or eligible to be listed on the national register of
historic places shall be considered for historical classification by the
Adirondack Park Agency (APA) and consult with the department of environ-

mental conservation in developing unit management plans (UMPs).

Section 2 establishes the effective date.

 
JUSTIFICATION:

The Forest Preserve holds over 2.6 million acres of state land within
the Adirondack Park full of lands rich in recreational opportunity and
ecological significance. Unit Management Plans (UMPs) assess the
natural, physical, social and recreational resources of the landscape
and provide a solid foundation for the development of long-term land
management goals, objectives and actions. It is vital to the economy and
tourism of upstate New York to include historical lands or buildings
within this preserve to develop UMPs.

Several structures on this land have been saved by the state with a
historical land classification such as the St. Regis Mountain fire tower
and Great Camp Santanoni. Without a historical land classification, many
of these lands and buildings will be deemed as non-conforming structures
and subject to zoning requirements, therefore altering these historic
buildings.

This bill provides that any lands or building located within the forest
preserve that are listed or eligible in the national historic register
shall be considered for an historical classification by the APA, in
consultation with DEC, in developing unit management plans.

 AN ACT approving land transactions relating to the implementation of the
   land exchange for the forest preserve health and safety  land  account
   and public utility improvements

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Pursuant to section 1 of article 14 of the State  Constitu-
 tion,  as  amended  at  the general election held in November, 2017, the
 legislature approves the lands to be conveyed to the State as  described
 in  section  three of this act, which adds in excess of the required 250
 acres to the forest preserve necessary to allow the use  of  the  forest
 preserve  health  and safety account for projects authorized pursuant to
 title 21 of article 9 of the environmental conservation law.
   § 2. Title to the land described in section three of this act shall be
 approved by the attorney general, and the deeds to  the  people  of  the
 state  of  New  York  of  such  described lands shall be approved by the
 attorney general as to the form and manner of execution and recordabili-
 ty prior to its delivery to  the  respective  county  clerk  office  for
 recording.
   §  3.  The lands to be conveyed to the state are described as follows:
 ALL THOSE CERTAIN PIECES OR PARCELS OF LAND situate lying and  being  in
 the Town of Olive, Ulster County and in the Town of Moriah, Essex County
 and  State  of New York being generally described as Ulster County, Town
 of Olive  Tax  Parcels  45.1-1-1.212  and  45.1-1-1.331,  consisting  of
 approximately  214 acres of land and as Essex County, Town of Moriah Tax
 Parcels 96.3-1-21.001, 106.00-1-1.1, 106.00-1-2, 106.00-1-3,  106.00-1-4
 and  106.00-1-22,  consisting  of approximately 1206 acres of land, said
 parcels being more specifically described to wit:

   BEGINNING at a point in the center of Watson Hollow Road (County Route
 42)  at  the westerly corner of lands now or formerly of Lisa Hubbard as
 described in Liber 4214 of deeds at page 47, and runs thence along  said
 lands South 48°44'45" East 494.90 feet to a found rebar set in a pile of
 stones  on  the  westerly  boundary of lands now or formerly of Denis J.
 Moran & Judith A. Moran as described in Liber 554 of deeds at page  335,
 said  last  mentioned  course at distances of 20.00 feet and 250.00 feet
 passes through 5/8 inch diameter rebars with  a  plastic  cap  inscribed
 "Brooks  & Brooks---Property Line" set, thence along said lands of Moran
 the following five courses and distances:
   1) South 22°11'37" West 270.37 feet to a found 1/2 inch diameter metal
 pipe set at the northerly end of a stone wall,
   2) along said wall South 03°12'32" East 220.04 feet to  a  cornered  8
 inch diameter Birch tree,
   3) South 42°52'59" East 198.81 feet to a found 2 foot diameter pile of
 stones,
   4)  South  38°10'19"  East  433.80 feet to a found stone on end in a 2
 foot diameter pile of stones and
   5) South 25°58'16" East 1,179.61 feet to a found 2 foot diameter  pile
 of  stones at the northwesterly corner of lands of the State of New York

TITLE OF BILL:

An act approving land transactions relating to the implementation of the
land exchange for the forest preserve health and safety land account and
public utility improvements

 
PURPOSE:

This bill would approve land acquisition required to implement the
constitutionally authorized Forest Preserve health and safety land
account.

 
SUMMARY OF PROVISIONS:

Section 1 of this bill approves the lands to be conveyed to the State,
adding 1,420 acres to the Forest Preserve, far exceeding the two hundred
fifty-acre addition to the forest preserve which is required by the
constitutional amendment creating the forest preserve health and safety

land account.

Section 2 of this bill states that the title of the land described in
section 3 of the bill, as well as the deeds to the people of New York
State, shall be approved by the attorney general.

Section 3 of this bill describes the lands to be conveyed to the state;
the first parcel being 214 acres and the second parcel being approxi-
mately 1206 acres.

Section 4 of this bill provides that this bill would take effect imme-
diately.

 
JUSTIFICATION:

In 2017, the voters approved an amendment to Article XIV, Section 1 of
the State Constitution, authorizing the creation of a 250-acre Health
and Safety Land account from Forest Preserve land, to be used for bridge
and highway safety, highway relocation and wells for drinking water. The
amendment and its implementing legislation, as set forth in Title 21 of
Article 9 of the Environmental Conservation Law (ECL), provides that
before such lands may be used by municipalities in the Adirondacks and
Catskills, not less than 250 acres must be acquired by the State for
inclusion in the Forest Preserve, with legislative approval.

This legislation details the two parcels that will be added to the
forest preserve as required by the Constitutional amendment and Title 21
of Article 9 of the ECL. The first parcel is located in the Catskills in
the Town of Olive in Ulster County, consisting of approximately 214
acres of land, and the second parcel is located in the Adirondacks in
the Town of Moriah in Essex County, consisting of approximately 1206
acres of land. These two parcels total approximately 1,420 acres, which
far exceeds the constitutional amendment and implementing legislation's
250-acre requirement.

The proposed Ulster County land acquisition represents an opportunity
for the state of New York to conserve open space, protect the New York
City watershed, enhance ecosystems by building on large blocks of
unfragmented forests in the Catskills, and enhance public access to
forest preserve land. In addition, the property provides excellent hunt-
ing opportunities, with many signs of deer, bear, and squirrel, opportu-
nities for fishing along the Bushkill creek, as well as locations for
camping and wildlife observation. The parcel is close to hiking trails
and the high peaks of the Catskill Mountains, furrther enhancing the
parcels recreational value. In addition, because the Bushkill Creek in
the town of Olive flows directly into the Ashokan Reservoir, the
proposed acquisition would provide the opportunity to preserve and
protect the tributaries and creeks in Ashoken watershed, which provides
approximately 40 percent of New York City's daily drinking water needs.

The proposed Essex County land acquisition would provide natural
resource protection and public recreation opportunities in an under-uti-
lized area of the Adirondack Park. Adding this property to the forest
Preserve will conserve the headwaters of an important watershed in the
Lake Champlain basin Property shares boundaries with existing protected
lands. The land presents opportunities for hunting, wildlife viewing,
fishing, paddling, camping, hiking, cross-country skiing, and snowshoe-
ing. In addition, the land contains Eagles Nest Pond, which is a histor-
ic eagle-nesting site, as well as historic brook trout pond and Rockport
Pond. This acquisition will buffer protection of these ponds and allow
for potential restoration and management of the fisheries. The land also
contains the 57- acre Tub Mill Pond Dam, along Mill Brook, which was
reconstructed by the private landowner in 2013.
