 AN ACT to amend the parks, recreation and historic preservation law,  in
   relation to establishing the Nissequogue River state park

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. The parks, recreation  and  historic  preservation  law  is
 amended by adding a new section 13.32 to read as follows:
   § 13.32 NISSEQUOGUE RIVER STATE PARK. 1. THE COMMISSIONER SHALL DESIG-
 NATE,  PURSUANT  TO SECTION 13.03 OF THIS ARTICLE, THOSE PARCELS OF LAND
 SPECIFIED IN SUBDIVISION TWO OF THIS SECTION TO BE THE PART OF THE STATE
 PARK SYSTEM TO BE KNOWN AS THE "NISSEQUOGUE RIVER STATE PARK".
   2. THE NISSEQUOGUE RIVER STATE PARK SHALL CONSTITUTE THOSE LANDS DEDI-
 CATED BY THE COMMISSIONER AS THE NISSEQUOGUE RIVER STATE PARK  IN  1999,
 IN  ADDITION  TO APPROXIMATELY 365.68± ACRES MORE OR LESS OF STATE LANDS
 WITHIN THE FORMER KINGS PARK PSYCHIATRIC CENTER, INCLUDING  TWO  PARCELS
 AGGREGATING  4.2± ACRES MORE OR LESS LOCATED ADJACENT TO A CEMETERY THAT
 IS LOCATED ON THE WESTERN EXTREMITY OF THE 365.68± ACRE PARCEL.
   ALL THAT CERTAIN TRACT, PIECE OR PARCEL OF  LAND  SITUATE,  LYING  AND
 BEING  IN  THE TOWN OF SMITHTOWN, COUNTY OF SUFFOLK, STATE OF NEW  YORK,
 LYING NORTHERLY OF MAIN STREET (NYS ROUTE  25A),  SOUTHEASTERLY  OF  OLD
 DOCK ROAD AND NORTHWESTERLY OF LAWRENCE ROAD, AND BEING MORE PARTICULAR-
 LY BOUNDED AND DESCRIBED AS FOLLOWS:
   BEGINNING  AT THE INTERSECTION OF THE COMMON LINE BETWEEN THE LANDS OF
 THE PEOPLE OF THE STATE OF NEW YORK, KINGS PARK  PSYCHIATRIC  CENTER  ON
 THE  WEST  AND THE LANDS NOW OR FORMERLY OF UNITED STATES POSTAL SERVICE
 AS DESCRIBED IN BOOK 84 OF PATENTS AT PAGE 132  ON  THE  EAST  WITH  THE
 NORTHERLY  MARGIN  OF  MAIN  STREET (NYS ROUTE 25A) AND RUNS THENCE FROM
 SAID POINT OF BEGINNING ALONG SAID NORTHERLY MARGIN  THE  FOLLOWING  TWO
 (2) COURSES: 1) NORTH 89 DEG. 43 MIN. 51 SEC. WEST, A DISTANCE OF 141.48

 AN  ACT  requiring  the  development,  adoption  and implementation of a
   master plan for the Nissequogue River State Park
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.    Legislative  intent. The legislature finds and declares
 that Kings Park in the town of Smithtown is home to a  large  parcel  of
 land  commonly  referred  to  as the Kings Park Psychiatric Center ("the
 center"). The center was closed in 1996, and in 2000, 153 acres  of  the
 center  were designated state parkland, thereby creating the Nissequogue
 River State Park ("NRSP"). In 2006,  an  additional  368  acres  of  the
 center's  property  was  administratively transferred by and between the
 office of general services, the department of mental  hygiene,  and  the
 office of parks, recreation and historic preservation.
   The  legislature further finds and declares that for most, the initial
 2000 and subsequent 2006 administrative actions taken to  establish  and
 then  expand  the  center's  property  into  the  eventual NRSP is fully
 dispositive of the will of the community and the efforts  of  local  and
 state elected officials. For others, the actions are viewed as suscepti-
 ble  to  administrative  fiat  and therefore a statutory codification is
 required.
   The legislature therefore finds and declares that this legislation  is
 needed  to:  (a)  codify  and ensure that the 2000 and 2006 transfers of
 land from the center to establish the NRSP are protected  from  adminis-
 trative changes; and (2) develop a master plan for the NRSP.
