   printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to the  establishment
   of  obstetric  hemorrhage  protocols;  and providing for the repeal of
   certain provisions upon the expiration thereof

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Subdivision  1 of section 206 of the public health law is
 amended by adding a new paragraph (w) to read as follows:
   (W) PROVIDE GUIDANCE TO HOSPITALS ON OBSTETRIC  HEMORRHAGE  PROTOCOLS,
 IN CONSULTATION WITH CLINICAL EXPERTS, AND DEVELOP OR IDENTIFY AN EXIST-
 ING  TOOLKIT  ON  OBSTETRIC  HEMORRHAGE  MANAGEMENT, WHICH MAY INCLUDE A
 HEMORRHAGE CARE CHECKLIST FOR USE BY HOSPITALS AS PART OF THE  PROTOCOLS
 AND  GUIDANCE  ON  SIMULATION TRAINING. THE COMMISSIONER SHALL REPORT TO
 THE TEMPORARY PRESIDENT OF THE SENATE AND THE SPEAKER OF THE ASSEMBLY ON
 DATA COLLECTED PURSUANT TO PARAGRAPH (C) OF SUBDIVISION ONE  OF  SECTION
 TWENTY-EIGHT  HUNDRED  THREE-N OF THIS CHAPTER WITHIN TWO YEARS FROM THE
 EFFECTIVE DATE OF THIS PARAGRAPH, AND BIENNIALLY THEREAFTER.
   § 2. Subdivision 1 of section 2803-n  of  the  public  health  law  is
 amended by adding a new paragraph (c) to read as follows:
   (C)  THE  HOSPITAL  SHALL  ADOPT,  IMPLEMENT,  PERIODICALLY UPDATE AND
 SUBMIT TO THE DEPARTMENT STANDARD PROTOCOLS FOR MANAGEMENT OF  OBSTETRIC
 HEMORRHAGE.  SUCH  PROTOCOLS SHALL ADDRESS EARLY RECOGNITION AND ASSESS-
 MENT, READINESS TO RESPOND  IN  A  MULTIDISCIPLINARY  MANNER,  AND  DATA
 REPORTING TO THE DEPARTMENT SUFFICIENT FOR THE DEPARTMENT TO MONITOR AND
 REPORT  PURSUANT  TO  PARAGRAPH  (W)  OF  SUBDIVISION ONE OF SECTION TWO
 HUNDRED SIX OF THIS CHAPTER. SUCH PROTOCOLS SHALL UTILIZE  RISK  ASSESS-
 MENT  TOOLS SUCH AS THE TOOLKIT ESTABLISHED OR IDENTIFIED BY THE DEPART-
 MENT UNDER PARAGRAPH (W) OF SUBDIVISION ONE OF SECTION TWO  HUNDRED  SIX
 OF  THIS  CHAPTER  AND  SHALL  INCLUDE A RESPONSE PLAN PROVIDING FOR THE
 TRIAGE AND TRANSFER TO HIGHER LEVEL FACILITIES IF NEEDED.

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   (C) (I) THE  COMMISSIONER  SHALL  PROVIDE  GUIDANCE  TO  HOSPITALS  ON
 OBSTETRIC  HEMORRHAGE  PROTOCOLS, IN CONSULTATION WITH CLINICAL EXPERTS,
 AND DEVELOP OR IDENTIFY AN  EXISTING  TOOLKIT  ON  OBSTETRIC  HEMORRHAGE
 MANAGEMENT,  WHICH  MAY  INCLUDE A HEMORRHAGE CARE CHECKLIST  FOR USE BY
 HOSPITALS AS PART OF THE PROTOCOLS AND GUIDANCE ON SIMULATION  TRAINING.
 THE  COMMISSIONER  SHALL REPORT TO THE TEMPORARY PRESIDENT OF THE SENATE
