 AN ACT to authorize Curt McDermott to take the competitive civil service
   examination and be placed on the eligible list for  appointment  as  a
   full-time police officer

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding the provisions of section 58 of  the  civil
 service  law  or any other provision of law to the contrary, Curt McDer-
 mott, who has been continuously employed by the town of  Shawangunk,  in
 the  county  of Ulster, as a part-time police officer, shall be eligible
 to take the competitive civil service examination for  the  position  of
 police officer and shall, contingent upon his score on such examination,
 be eligible to be placed on the eligible list for appointment as a full-
 time police officer.
   §  2.  Curt  McDermott  shall  otherwise  be  subject to the merit and
 fitness provisions of the civil  service  law  applicable  to  full-time
 police officers.
   § 3. This act shall take effect immediately.

TITLE OF BILL:  An act to authorize Curt McDermott to take the compet-
itive civil service examination and be placed on the eligible list for
appointment as a full-time police officer with the town of Shawangunk

 
PURPOSE OR GENERAL IDEA OF BILL:

Allows Curt McDermott to take the competitive civil service examination
and be placed on the eligible list for appointment as a full-time police
officer

 
SUMMARY OF PROVISIONS:

Section 1: Allows Curt McDermott to be eligible to take the competitive
civil service examination for the position of police officer and shall,
contingent upon his score on such examination, be eligible to be placed
on the eligible list for appointment as a full-time police officer

Section 2: Curt McDermott shall otherwise be subject to the merit and

fitness provisions of the civil service law applicable to full-time
police officers

 
JUSTIFICATION:

Section 58 of the New York State Civil Service Law prohibits an individ-
ual over the age of 35 from taking the competitive civil service exam-
ination for the position of police officer. Curt McDermott is currently
a part-time police officer for the Town of Shawangunk. Officer McDermott
is in good standing and physically capable of performing the job duties
of a full-time police officer.  This legislation is necessary to allow
Officer McDermott to be converted to full-time status and will save the
town financially over a long period of time
