BILL NUMBER: S5121 SPONSOR: CARLUCCI TITLE OF BILL: An act to amend the mental hygiene law, in relation to duties of providers of service to people with developmental disabilities PURPOSE OR GENERAL IDEA OF BILL: The purpose of this bill is to inform programs and their employees under the auspice of the Office for People with Developmental Disabilities (OPWDD) when to make a report to the Justice Center and/or call 911. SUMMARY OF PROVISIONS: A.1370-A would amend 9 16.13 of the Mental Hygiene Law by adding a new subdivision (e) to require programs licensed, certified, operated, authorized or funded by the Office for People with Developmental Disa- bilities (OPWDD) to post visible notice in a public area notifying employees that such employee is to call 911 in the event of an emergen- cy. Additional information would be posted by those programs mandated to report alleged incidents of abuse or neglect pursuant to § 16.29 of the

CARLUCCI -- read twice and ordered printed, and when printed to be committed to the Committee on Mental Health and Develop- mental Disabilities AN ACT to amend the mental hygiene law, in relation to duties of provid- ers of service to people with developmental disabilities THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Section 16.13 of the mental hygiene law is amended by adding a new subdivision (e) to read as follows: (E) POSTING A VISIBLE NOTICE IN A PUBLIC AREA VISIBLE TO EMPLOYEES INFORMING SUCH EMPLOYEES TO CALL 911 IN THE EVENT OF AN EMERGENCY FOR PROGRAMS LICENSED, CERTIFIED, OPERATED, AUTHORIZED OR FUNDED BY THE OFFICE. PROVIDED HOWEVER, FOR PROGRAMS REQUIRED TO REPORT INCIDENTS OF ABUSE AND NEGLECT PURSUANT TO SECTION 16.29 OF THIS ARTICLE, THE NOTICE SHALL ALSO INFORM EMPLOYEES THAT, PURSUANT TO ARTICLE ELEVEN OF THE SOCIAL SERVICES LAW, THEY SHALL REPORT TO THE JUSTICE CENTER FOR THE PROTECTION OF PEOPLE WITH SPECIAL NEEDS IF IT IS BELIEVED THAT ABUSE OR NEGLECT OF A SERVICE RECIPIENT HAS OCCURRED AND IN ACCORDANCE WITH POLI- CIES AND PROCEDURES ESTABLISHED PURSUANT TO SUBDIVISION FIVE OF SECTION FOUR HUNDRED NINETY-ONE OF THE SOCIAL SERVICES LAW, CONTACT LAW ENFORCE- MENT IF IT IS BELIEVED THAT SUCH ABUSE OR NEGLECT CONSTITUTES A CRIME; AND SUCH NOTICE SHALL CONTAIN THE PHONE NUMBER OF THE JUSTICE CENTER HOTLINE AND LOCAL LAW ENFORCEMENT ENTITY. § 2. SUMMARY OF PROVISIONS: Section 1 of the bill amends § 16.13 of the Mental Hygiene Law by adding a new subdivision (e) to require programs licensed, certified, operated, or authorized by the Office for People with Developmental Disabilities (OPWDD) to post signs informing individuals to call 911 in the event of an emergency. Such signs shall be posted and visible in common areas, be not less than eight and one-half inches by eleven inches and shall read: In case of an emergency, dial 911".
