BILL NUMBER: S5782 SPONSOR: PARKER TITLE OF BILL: An act to amend the public service law, in relation to commercial mobile radio service providers PURPOSE: This legislation would give the New York State Public Service Commission authority to grant eligible telecommunications carrier (ETC) desig- nations to wireless telecommunications providers - an authority the Commission had previously. SUMMARY OF PROVISIONS: Subdivision 6 of section 5 of the public service law is amended to allow for the designation of wireless telecommunications providers as eligible telecommunications carriers for the purpose of providing wireless life- line services.

PARKER -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Telecommuni- cations AN ACT to amend the public service law, in relation to commercial mobile radio service providers THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 6 of section 5 of the public service law is amended by adding a new paragraph c to read as follows: C. NOTWITHSTANDING PARAGRAPH A OF THIS SUBDIVISION, THE COMMISSION MAY DESIGNATE ANY COMMERCIAL MOBILE RADIO SERVICE PROVIDERS AS AN ELIGIBLE TELECOMMUNICATIONS CARRIER FOR PURPOSES OF PROVIDING LIFELINE SERVICE, IN ADDITION TO ANY COMMERCIAL MOBILE RADIO SERVICE PROVIDERS DESIGNATED AS SUCH PURSUANT TO 47 U.S.C. § 214(E). THE COMMISSIONER IS AUTHORIZED TO PROMULGATE ALL RULES AND REGULATIONS NECESSARY TO IMPLEMENT THE PROVISIONS OF THIS PARAGRAPH. § 2. This act shall take effect immediately.
