 AN ACT to amend the transportation law, in  relation  to  requiring  the
   commissioner of transportation to establish methods of reporting safe-
   ty issues with limousines

   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Section 138 of the transportation law is amended by  adding
 a new subdivision 10 to read as follows:
   10.  (A)  TO ESTABLISH A SMARTPHONE APPLICATION, WEBSITE AND TOLL-FREE
 HOTLINE FOR REPORTING CUSTOMER SERVICE OR  SAFETY  ISSUES  WITH  ALTERED
 MOTOR  VEHICLES  COMMONLY  REFERRED  TO  AS STRETCH LIMOUSINES WHICH ARE
 DESIGNED OR MODIFIED FOR PURPOSES OF HAVING A SEATING CAPACITY  OF  NINE
 OR MORE PASSENGERS.
   (B)  NOTWITHSTANDING  ANY  LAW  OR  REGULATION  TO  THE CONTRARY, SUCH
 REPORTS SHALL BE CONSIDERED BY THE  COMMISSIONER  FOR  THE  PURPOSES  OF
 WITHDRAWING  A  MOTOR  CARRIER'S OPERATING AUTHORITY OR DENYING APPLICA-
 TIONS FOR NEW OR REVISED OPERATING  AUTHORITY,  INCLUDING  EMERGENCY  OR
 TEMPORARY OPERATING AUTHORITY.
   (C)  THE  COMMISSIONER  SHALL  REQUIRE MOTOR CARRIERS TO AFFIX SIGNAGE
 WITHIN EACH MOTOR VEHICLE USED TO TRANSPORT PASSENGERS FOR  COMPENSATION
 IN  A  PROMINENT  LOCATION  IN  THE  PASSENGER COMPARTMENT PROVIDING THE
 WEBSITE ADDRESS AND TOLL-FREE HOTLINE NUMBER. THE FORM AND  LOCATION  OF
 THE SIGNAGE SHALL BE DESIGNED OR APPROVED BY THE COMMISSIONER.
   (D)  THE  COMMISSIONER  SHALL  DESIGN  THE  REPORTING SYSTEM TO ENABLE
 CUSTOMERS TO ASSESS THE SERVICE  PROVIDED  BY  THEIR  MOTOR  CARRIER  BY
 NUMERICAL  OR  LETTER  SCORING.  THE  COMMISSIONER  SHALL  ALSO DESIGN A
 REPORTING SYSTEM FOR REPORTING SUBSTANTIATED CLAIMS OF SAFETY ISSUES  OR
 FAILURE TO COMPLY WITH THIS ARTICLE OR ARTICLE NINETEEN-A OF THE VEHICLE
 AND TRAFFIC LAW BY CUSTOMERS OR OTHER INDIVIDUALS WITH KNOWLEDGE OF SUCH
 ISSUES OR COMPLIANCE FAILURES. SUCH REPORTING SYSTEM SHALL INCLUDE WITH-
 
  EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets

 COMMISSIONER OF MOTOR VEHICLES SHALL REQUIRE EVERY  SUCH  ALTERED  MOTOR
 VEHICLE REGISTERED IN THIS STATE TO HAVE POSTED THEREIN A NOTICE PROVID-
 ING  THE  WEBSITE  ADDRESS, TOLL-FREE HOTLINE NUMBER, AND INFORMATION ON
 HOW TO DOWNLOAD  THE  SMARTPHONE  APPLICATION,  IN  A  FORM  AND  MANNER
 APPROVED  BY  THE  COMMISSIONER  OF MOTOR VEHICLES. SUCH NOTICE SHALL BE
 POSTED IN A MANNER LEGIBLE AND CONSPICUOUS TO PASSENGERS IN ALL  SEATING
 POSITIONS  OF  SUCH  ALTERED  MOTOR  VEHICLES.  FOR THE PURPOSES OF THIS
 SUBDIVISION, THE TERM "SAFETY ISSUES" SHALL INCLUDE, BUT NOT BE  LIMITED
 TO,  THE  OPERATIONAL  CONDITION  AND  FUNCTIONING OF SUCH ALTERED MOTOR
