 AN ACT to create a moratorium on the annexation of agricultural land  by
   localities for an industrial use
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Moratorium on the annexation of agricultural land.  1.  For
 the purposes of this act:
   (a)  "agricultural  land"  shall include any lands that support a farm
 operation, that are used in agricultural production, or any lands refer-
 enced in section 301 of the agriculture and markets law; and
   (b) "industrial use" shall mean the use of land as an industrial  park
 or  a  distribution center as defined in subdivision 6 of section 352 of
 the economic development law.
   2. Notwithstanding any provision of law  to  the  contrary,  there  is
 hereby established a moratorium upon the annexation of agricultural land
 in  this state by a county, town, village, or municipality for an indus-
 trial use.  The moratorium shall continue for a period of one year  from
 the  effective date of this act or until the commissioner of the depart-
 ment of environmental conservation determines such moratorium  shall  be
 lifted.
   § 2. This act shall take effect immediately.

 AN  ACT to create a moratorium on the annexation of agricultural land by
   certain localities for an industrial use

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Any  town within a county with a population of fifty-five
 thousand or  less  that  has  completed  an  agricultural  and  farmland
 protection  plan  pursuant to section 324 of the agriculture and markets
 law prior to the effective date of this act, may  impose  a  moratorium,
 not  to  exceed one year, on the annexation of agricultural land greater
 than two hundred acres for an industrial use, to allow for the  develop-
 ment of an updated agricultural and farmland protection plan.
   § 2. This act shall take effect immediately.
