BILL NUMBER: S6411 SPONSOR: KAVANAGH TITLE OF BILL: An act to amend the public authorities law, in relation to increasing financing for project costs of the Battery Park city authority PURPOSE OF THE BILL: The purpose of this bill is to amend the public authorities law to authorize an increase in the allowed amount of outstanding debt for the financing of critical infrastructure and resiliency related projects in Battery Park. SUMMARY OF PROVISIONS: Section 1. Amends paragraph (a) of subsection 1 of section 1977-a of the public authorities law to increase Battery Park City Authority's bonding capacity from a maximum amount of three hundred million dollars to a maximum amount of six hundred, fifty million dollars.

KAVANAGH -- (at request of the Battery Park City Authority) -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the public authorities law, in relation to increasing financing for project costs of the Battery Park city authority THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Paragraph (a) of subdivision 1 of section 1977-a of the public authorities law, as amended by chapter 241 of the laws of 1995, is amended to read as follows: (a) For the purpose of financing project costs for the project for the Battery Park project area other than the financing of loans, advances and mortgage loans to housing companies organized to provide housing within the Battery Park project area, the authority may issue bonds and notes in an aggregate principal amount at any one time outstanding not exceeding [three hundred] SIX HUNDRED FIFTY million dollars, excluding bonds and notes issued to refund outstanding bonds and notes. § 2. This act shall take effect immediately. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09040-02-9

SUMMARY OF SPECIFIC PROVISIONS: Section one amends paragraph (a) of subsection 1 of section 1977-a of the public authorities law to provision Battery Park City Authority with a non-revolving bonding capacity not to exceed five hundred million dollars. Section two sets forth the effective date.

Subdivision 1 of section 1977-a of the public authorities law is amended by adding a new paragraph (f) to read as follows: (F) ADDITIONAL AUTHORIZATIONS. FOR THE PURPOSE OF FINANCING CAPITAL COSTS IN CONNECTION WITH A PROGRAM OF INFRASTRUCTURE CONSTRUCTION, IMPROVEMENTS AND OTHER CAPITAL EXPENDITURES FOR THE PROJECT AREA, THE AUTHORITY MAY, IN ADDITION TO THE AUTHORIZATIONS CONTAINED ELSEWHERE IN THIS TITLE, BORROW MONEY BY ISSUING BONDS AND NOTES IN AN AGGREGATE PRINCIPAL AMOUNT NOT EXCEEDING FIVE HUNDRED MILLION DOLLARS, PLUS A PRINCIPAL AMOUNT OF BONDS OR NOTES ISSUED (I) TO FUND ANY RELATED DEBT SERVICE RESERVE FUND, (II) TO PROVIDE CAPITALIZED INTEREST, AND (III) TO PROVIDE FOR FEES AND OTHER CHARGES AND EXPENSES INCLUDING ANY UNDERWRIT- ERS' DISCOUNTS, RELATED TO THE ISSUANCE OF SUCH BONDS OR NOTES, ALL AS DETERMINED BY THE AUTHORITY, EXCLUDING BONDS AND NOTES ISSUED TO REFUND OUTSTANDING BONDS AND NOTES ISSUED PURSUANT TO THIS SECTION. § 2.
