BILL NUMBER: S6470 SPONSOR: MAYER TITLE OF BILL: An act to amend the executive law, in relation to expanding the scope of unlawful discriminatory practices to include public education institutions PURPOSE OR GENERAL IDEA OF BILL:: The purpose of this bill is to make technical corrections to A.3425 which passed the Assembly earlier this year SUMMARY OF PROVISIONS:: Section 1 of the bill would add a new § 292.35 to the Executive Law to define "educational institution" to include language currently in Execu- tive Law § 296.4, which prohibits discrimination in an "education corpo- ration or association which holds itself out to the public to be nonsec- tarian and exempt from taxation pursuant to the provisions of article four of the real property tax law," and to expand the definition to include "any public school, including any school district, board of

MAYER -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the executive law, in relation to expanding the scope of unlawful discriminatory practices to include public education insti- tutions THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 35 of section 292 of the executive law, as added by a chapter of the laws of 2019, amending the executive law relating to expanding the scope of unlawful discriminatory practices to include public education institutions, as proposed in legislative bills numbers A. 3425 and S. 4901, is amended to read as follows: [35.] 37. The term "educational institution" shall mean: (a) any education corporation or association which holds itself out to the public to be [non-secretarian] NON-SECTARIAN and exempt from taxa- tion pursuant to the provisions of article four of the real property tax law; or (b) any public school, including any school district, board of cooper- ative [education] EDUCATIONAL services, public college or public univer- sity. § 2. This act shall take effect on the same date and in the same manner as a chapter of the laws of 2019, amending the executive law relating to expanding the scope of unlawful discriminatory practices to include public education institutions, as proposed in legislative bills numbers A. 3425 and S. 4901, takes effect.
