BILL NUMBER: S6483 SPONSOR: BROOKS TITLE OF BILL: An act to amend the military law, in relation to age requirements applicable to appointments or promotions of public employ- ees who have been absent on military duty PURPOSE: The purpose of this bill is to increase by one year the number of years of military service that can be deducted from the age of an applicant for appointments or promotions for positions in public service. SUMMARY OF PROVISIONS: Section 1. amends subdivision 10-a of section 243 of the military law to increase by one the number of years that military service may be deducted from the age of an applicant for appointments or promotions for positions in public service for purposes of positions with an estab- lished age requirement.

BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the military law, in relation to age requirements appli- cable to appointments or promotions of public employees who have been absent on military duty THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. Subdivision 10-a of section 243 of the military law, as amended by chapter 278 of the laws of 1994, is amended to read as follows: 10-a. Age requirements. If maximum age requirements are established by law, or rule or by action of a civil commission for examination for, or for appointment or promotion to, any position in the public service, the period of military duty as hereinbefore defined, the period of service after June twenty-seventh, nineteen hundred fifty, voluntarily entered upon between January first, nineteen hundred forty-seven, and June twen- ty-seventh, nineteen hundred fifty, if such service otherwise falls within the definition of military duty, and the period of terminal leave granted by the military authorities of a candidate or eligible shall not be included in computing the age of such candidate or eligible for the purposes of such examination or appointment or promotion; provided, however, that neither shall the total time deducted hereunder in comput- ing the age of a candidate or eligible exceed [six] SEVEN years. § 2.
