 Introduced  by  Sen.  JACOBS -- read twice and ordered printed, and when
   printed to be committed to the Committee on Transportation
 
 AN ACT to amend the vehicle and traffic law, in relation to allowing the
   federal government access to  certain  department  of  motor  vehicles
   information  for  the  purposes  of reviewing applications for federal
   programs, federal law enforcement,  national  security  and  used  car
   exports; and to repeal certain provisions of such law related thereto
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Subdivision 12 of section 201 of the  vehicle  and  traffic
 law  is REPEALED and two new subdivisions 12 and 13 are added to read as
 follows:
   12. NOTWITHSTANDING SUBDIVISIONS EIGHT, NINE, TEN, AND ELEVEN OF  THIS
 SECTION,  WHEN A FEDERAL AGENCY THAT PRIMARILY ENFORCES IMMIGRATION LAW,
 INCLUDING BUT NOT LIMITED  TO  UNITED  STATES  IMMIGRATION  AND  CUSTOMS
 ENFORCEMENT  AND  UNITED  STATES  CUSTOMS  AND BORDER PROTECTION, OR ANY
 SUCCESSOR AGENCIES HAVING SIMILAR DUTIES REQUESTS DOCUMENTS, RECORDS, OR
 OTHER INFORMATION FOR THE PURPOSES OF SUCH AGENCY'S REVIEW OF AN  APPLI-
 CATION  SUBMITTED BY A PERSON FOR A FEDERAL PROGRAM, OR FOR THE PURPOSES
 OF INVESTIGATING A PERSON FOR FEDERAL LAW  ENFORCEMENT  AND/OR  NATIONAL
 SECURITY  ISSUES,  THE  COMMISSIONER  SHALL  DISCLOSE AND OTHERWISE MAKE
 ACCESSIBLE ANY REQUESTED DOCUMENTS, RECORDS, OR OTHER INFORMATION  WHERE
 THE SUBJECT OF THE REQUEST IS THE SUBJECT OF SUCH DOCUMENTS, RECORDS, OR
 OTHER INFORMATION.
   13.  NOTWITHSTANDING  SUBDIVISIONS EIGHT, NINE, TEN, ELEVEN AND TWELVE
 OF THIS SECTION, WHEN A FEDERAL AGENCY  THAT  PRIMARILY  ENFORCES  IMMI-
 GRATION  LAW, INCLUDING BUT NOT LIMITED TO UNITED STATES IMMIGRATION AND
 CUSTOMS ENFORCEMENT AND UNITED STATES CUSTOMS AND BORDER PROTECTION,  OR
 ANY   SUCCESSOR  AGENCIES  HAVING  SIMILAR  DUTIES  REQUESTS  DOCUMENTS,
 RECORDS, OR OTHER INFORMATION FOR THE PURPOSES OF SUCH AGENCY  APPROVING
 A VEHICLE FOR EXPORT, THE COMMISSIONER SHALL DISCLOSE AND OTHERWISE MAKE
 ACCESSIBLE  ANY REQUESTED DOCUMENTS, RECORDS, OR OTHER INFORMATION WHERE
 THE VEHICLE PENDING APPROVAL IS THE SUBJECT OF SUCH DOCUMENTS,  RECORDS,
 OR OTHER INFORMATION.
   § 2. This act shall take effect immediately.
