TITLE OF BILL:

An act to amend the public housing law, in relation to establishing a
public housing construction and preservation fund for the city of New
York

 
PURPOSE OR GENERAL IDEA OF BILL:

To create an independent entity with exclusive authority to lead
construction and rehabilitation efforts necessary for the continued
operation of the New York City Housing Authority.

 
SUMMARY OF PROVISIONS:

The bill adds a new Title 1-A to Article 13 of the Public Housing Law
to: create the New York City Public Housing Construction and Preserva-
tion Fund; set forth the governance of such Fund by a board of trustees,
which shall not include any member of the board of directors of the New

York City Housing Authority (NYCHA) nor any officer or employee of the
city or state and shall be overseen by a president with extensive execu-
tive-level construction experience; and grant the Fund the exclusive
authority to design, construct, reconstruct, improve, rehabilitate,
maintain, furnish, repair, equip and otherwise provide for projects for
NYCHA pursuant to agreements with NYCHA.

 
JUSTIFICATION:

The New York City Housing Authority (NYCHA) is facing an unprecedented
capital need. It's estimated that the agency will require $32 billion to
repair its infrastructure over the next five years, with the total
increasing for every year that necessary maintenance is deferred due to
factors such as inflation and rising construction costs.  For this
reason, NYCHA must be able to raise and spend capital dollars quickly
and efficiently. The creation of a separate development entity to lead
NYCHA's capital projects is one option to streamline development efforts
and ensure that New York City's public housing is restored to and
remains in - safe, habitable condition for its nearly 400,000 residents.

EFFECTIVE DATE:
This act shall take effect on the one hundred and eightieth day after it

 AN  ACT  to  amend the public housing law, in relation to establishing a
   public housing construction and preservation fund for the city of  New
   York
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Article 13 of the public housing law is amended by adding a
 new title 1-A to read as follows:
                                 TITLE 1-A
        NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION
                                   FUND
 SECTION 402-F. DEFINITIONS.
         402-G. NEW YORK CITY PUBLIC HOUSING CONSTRUCTION  AND  PRESERVA-
                  TION FUND.
         402-H. POWERS AND DUTIES OF THE FUND.
   § 402-F. DEFINITIONS. AS USED IN THIS TITLE, THE FOLLOWING TERMS SHALL
 HAVE  THE FOLLOWING MEANINGS, UNLESS THE CONTEXT CLEARLY REQUIRES OTHER-
 WISE:
   1. "FUND" SHALL MEAN THE NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND
 PRESERVATION FUND.
   2. "BOARD" SHALL MEAN THE BOARD OF  TRUSTEES  OF  THE  NEW  YORK  CITY
 PUBLIC HOUSING CONSTRUCTION AND PRESERVATION FUND.
   3.  "PROJECT"  SHALL HAVE THE SAME MEANING AS SET FORTH IN SUBDIVISION
 FOURTEEN OF SECTION THREE OF THIS CHAPTER.
   § 402-G. NEW YORK CITY PUBLIC HOUSING  CONSTRUCTION  AND  PRESERVATION
 FUND.  1. THERE IS HEREBY ESTABLISHED A PUBLIC BENEFIT CORPORATION TO BE
 KNOWN AS THE "NEW YORK CITY PUBLIC HOUSING CONSTRUCTION AND PRESERVATION
 FUND".
   2. THE FUND SHALL BE GOVERNED BY, AND ITS POWERS  SHALL  BE  EXERCISED
 BY,  A BOARD OF TRUSTEES. NO MEMBER OF THE BOARD OF DIRECTORS OF THE NEW
 YORK CITY HOUSING AUTHORITY SHALL BE ONE OF THE APPOINTED MEMBERS OF THE

 BOARD, NOR SHALL AN OFFICER OR EMPLOYEE OF THE CITY OR STATE BE  ONE  OF
 THE APPOINTED MEMBERS OF THE BOARD.
   3. APPOINTED MEMBERS MAY ENGAGE IN PRIVATE EMPLOYMENT, OR IN A PROFES-
 SION  OR  BUSINESS,  UNLESS  OTHERWISE  PROHIBITED BY LAW, RULE OR REGU-
 LATION.
   4. TRUSTEES SHALL RECEIVE NO COMPENSATION FOR THEIR SERVICES BUT SHALL
 BE REIMBURSED FOR THE ACTUAL AND NECESSARY EXPENSES INCURRED BY THEM  IN
 THE PERFORMANCE OF THEIR OFFICIAL DUTIES AS TRUSTEES OF THE FUND.
   5.  THE BOARD SHALL APPOINT AS PRESIDENT OF THE FUND AN INDIVIDUAL WHO
 HAS EXTENSIVE EXECUTIVE-LEVEL CONSTRUCTION  EXPERIENCE.  THE  PRESIDENT,
 WHO  SHALL  NOT  BE  A MEMBER OF THE BOARD, SHALL BE THE CHIEF EXECUTIVE
 OFFICER OF THE FUND AND SHALL BE RESPONSIBLE FOR THE  DISCHARGE  OF  THE
 EXECUTIVE AND ADMINISTRATIVE FUNCTIONS AND POWERS OF THE FUND. THE PRES-
 IDENT SHALL SERVE AT THE PLEASURE OF THE BOARD.
   §  402-H.  POWERS  AND  DUTIES  OF THE FUND. NOTWITHSTANDING ANY OTHER
 PROVISION OF LAW TO THE CONTRARY, THE FUND SHALL HAVE THE POWER AND DUTY
 TO:
   1. APPOINT OFFICERS AND EMPLOYEES AND FIX THEIR COMPENSATION;
   2. DESIGN, CONSTRUCT, RECONSTRUCT,  IMPROVE,  REHABILITATE,  MAINTAIN,
 FURNISH,  REPAIR,  EQUIP  AND OTHERWISE PROVIDE FOR PROJECTS FOR THE NEW
 YORK CITY HOUSING AUTHORITY PURSUANT TO AGREEMENTS  WITH  THE  NEW  YORK
 CITY HOUSING AUTHORITY;
   3. ACQUIRE REAL AND PERSONAL PROPERTY, OR ANY INTEREST THEREIN, BY ANY
 METHOD,  NECESSARY  OR  CONVENIENT  FOR  THE  EXERCISE OF ITS FUNCTIONS,
 POWERS AND DUTIES;
   4. MAKE AND EXECUTE CONTRACTS AND ALL OTHER INSTRUMENTS  NECESSARY  OR
 CONVENIENT FOR THE EXERCISE OF ITS FUNCTIONS, POWERS AND DUTIES; AND
   5.  ENGAGE THE SERVICES OF PRIVATE CONSULTANTS ON A CONTRACT BASIS FOR
 RENDERING PROFESSIONAL AND TECHNICAL ASSISTANCE AND ADVICE.
   § 2. This act shall take effect on the one hundred eightieth day after
 it shall have become a law.
