Applies a special Medicaid rate of no less than one hundred twenty percent of the fee-for-service rate for residential health care facilities located in a county larger than two thousand square miles and operated by an organization with two hundred fifty certified beds or more.

   printed to be committed to the Committee on Health
 
 AN ACT to amend the public health law, in relation to applying a special
   Medicaid rate for certain residential health care facilities
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. Subdivision 2-c of section 2808 of the public health law is
 amended by adding a new paragraph (h) to read as follows:
   (H)  NOTWITHSTANDING  ANY  OTHER PROVISION OF LAW OR REGULATION TO THE
 CONTRARY, ANY RESIDENTIAL HEALTH CARE FACILITY ESTABLISHED  PURSUANT  TO
 THIS  ARTICLE  LOCATED IN A COUNTY LARGER THAN TWO THOUSAND SQUARE MILES
 AND OPERATED BY AN ORGANIZATION WITH TWO HUNDRED FIFTY CERTIFIED BEDS OR
 MORE IN SUCH COUNTY ON JANUARY FIRST, TWO THOUSAND TWENTY SHALL BE REIM-
 BURSED AT A RATE OF NO LESS THAN ONE HUNDRED TWENTY PERCENT OF THE  FEE-
 FOR-SERVICE  RATE OF REIMBURSEMENT, CALCULATED PURSUANT TO THIS SECTION,
 FOR SUCH FACILITY FOR INPATIENT SERVICES  PROVIDED  ON  OR  AFTER  APRIL
 FIRST, TWO THOUSAND TWENTY.
   §  2.  This  act shall take effect on the thirtieth day after it shall
