TITLE OF BILL:

An act to amend the emergency tenant protection act of nineteen seven-
ty-four and the administrative code of the city of New York, in relation
to prohibiting the rent guidelines board from increasing rents on
certain leases during a state disaster emergency

 
PURPOSE OR GENERAL IDEA OF BILL:

To provide protection for rent-stabilized tenants from rent increases
during the term of a state declared disaster emergency, such as the
current coronavirus/COVID-19 outbreak.

 
SUMMARY OF PROVISIONS:

Sections 1 and2 amend respectively section 4 of section 4 of chapter 576
of the laws of 1974 and section 26-510 of the administrative code of the
city of New York by adding new subdivisions prohibiting a rent guide-

lines board from increasing the rent for any one-year leases during a
declared state disaster emergency.

Section 3 provides the effective date.

 
JUSTIFICATION:

New York's rent stabilized units offer stable and affordable housing to
millions. According to the latest Housing Vacancy Survey the median 2016
income of rent-stabilized households as a whole was $44,560, with a
median gross rent to income ratio of 36 percent, meeting the definition
of rent burdened. Rent-stabilized tenants are particularly susceptible
to the economic shocks caused by public health crises such as the 2020
coronavirus/COVID-19 outbreak, which is causing a significant uptick in
unemployment claims and other severe economic stresses.

Access to stable and affordable shelter during a disaster, especially
one that requires New Yorkers to stay indoors is critical to ensuring
our state can recover from the major economic and health impacts caused
by disasters. With many rent-stabilized tenants facing unemployment or
other unexpected costs such as medical bills during a state disaster
emergency, tenants should not be subject to the additional burden of
rising rents.

 AN  ACT  to amend the emergency tenant protection act of nineteen seven-
   ty-four and the administrative code  of  the  city  of  New  York,  in
   relation  to  prohibiting  the  rent  guidelines board from increasing
   rents on certain leases during a state disaster emergency
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1. Section 4 of section 4 of chapter 576 of the laws of 1974,
 constituting the emergency tenant protection act  of  nineteen  seventy-
 four, is amended by adding a new subdivision b-1 to read as follows:
   B-1. A RENT GUIDELINES BOARD SHALL NOT INCREASE THE RENT FOR ANY LEASE
 WITH A ONE YEAR TERM DURING ANY STATE DISASTER EMERGENCY DECLARED PURSU-
 ANT TO ARTICLE TWO-B OF THE EXECUTIVE LAW.
   § 2. Section 26-510 of the administrative code of the city of New York
 is amended by adding a new subdivision b-1 to read as follows:
   B-1. A RENT GUIDELINES BOARD SHALL NOT INCREASE THE RENT FOR ANY LEASE
 WITH A ONE YEAR TERM DURING ANY STATE DISASTER EMERGENCY DECLARED PURSU-
 ANT TO ARTICLE TWO-B OF THE EXECUTIVE LAW.
   §  3.  This act shall take effect immediately; provided, however, that
 the amendments to section 26-510 of the rent stabilization law of  nine-
 teen  hundred sixty-nine made by section two of this act shall expire on
 the same date as such law expires and shall not affect the expiration of
 such law as provided under section 26-520 of such law.
