TITLE OF BILL:

An act in relation to requiring the department of health to prepare a
report on the number of surplus ventilators within the state at the
conclusion of the COVID-19 state of emergency

 
SUMMARY OF PROVISIONS:

Section 1 provides that the Department of Health, upon conclusion of the
COVID-19 health crisis, must provide a report on the amount of surplus
ventilators and personal protection equipment in storage or reserve and
must specifically report on the siting of this equipment.

Section 1 provides that this report shall be divided into the ten
regional groups defined by the economic development law.

Section 2 requires the Department of Health to submit its report to the
Governor and legislative leaders no later than thirty days following the
conclusion of the COVID-19 state of emergency.

Section 3 provides for the effective date.

 
JUSTIFICATION:

During the 2020 COVID-19 state of emergency, a dire need for ventilators
and personal protection equipment arose across the nation and across New
York State. This crisis raised questions as to the overall readiness of
New York State to handle and respond to potential pandemics, specif-
ically with regard to the number of equipment held in reserve.

This bill will require the Department of Health to conduct an examina-
tion of available ventilators and personal protection equipment in stor-
age or reserve throughout the State of New York and requires the Depart-
ment to list where the equipment is being held, sorted by region. This
report will commence following the end of the COVID-19 state of emergen-
cy and will be due no more than 30 days following the end of the emer-
gency. By creating this study, the State can make sure that we know
where and how many pieces of equipment are available, ensuring that the
State can respond to potential crises of any kind.

 AN ACT in relation to requiring the department of health  to  prepare  a
   report  on  the  number of surplus ventilators within the state at the
   conclusion of the COVID-19 state of emergency
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The  department  of  health shall prepare a report on the
 quantity  of  surplus  ventilators  and  personal  protection  equipment
 located  in  storage  or reserve within the state upon the conclusion of
 the state of emergency declared by executive order  202  that  began  on
 March  7,  2020. Such report shall list every warehouse or other storage
 location where such equipment is being stored and identify the  quantity
 of  ventilators  and  personal  protection equipment located within each
 such warehouse or other storage location. Such list  of  warehouses  and
 other  storage  locations shall be divided into regional groups. For the
 purpose of this act, "regional  groups"  shall  mean  the  ten  economic
 development  regions  established  by  the  New York state department of
 economic development pursuant to section 230 of the economic development
 law.
   § 2. The department of health shall deliver such report to the  gover-
 nor,  the  speaker of the assembly, the minority leader of the assembly,
 the temporary president of the senate and the  minority  leader  of  the
 senate  no  later than thirty days after the state of emergency declared
 by executive order 202 that began on March 7, 2020 has been lifted.
   § 3. This act shall take effect immediately.
