 Introduced  by  Sen.  SEWARD -- read twice and ordered printed, and when
   printed to be committed to the Committee on Investigations and Govern-
   ment Operations
 
 AN ACT to amend the tax law, in relation to suspending the excise tax on
   certain drugs during a declared state of emergency
 
   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  Section  498  of  the  tax law is amended by adding a new
 subdivision (h) to read as follows:
   (H) DURING A STATE OF EMERGENCY AS DECLARED BY THE  GOVERNOR  FOR  THE
 NOVEL  CORONAVIRUS,  COVID-19,  NO  TAX  SHALL BE COLLECTED ON FENTANYL,
 HYDROMORPHONE, CODEINE AND ANY OTHER  FINISHED-DOSE  PRESCRIPTION  DRUGS
 IDENTIFIED  BY  THE  COMMISSIONER  OF HEALTH AS NECESSARY FOR THE PUBLIC
 HEALTH.
   § 2. This act shall take effect immediately and  shall  apply  to  all
 returns  filed  for  quarterly  periods  beginning on and after April 1,
