TITLE OF BILL:

An act to amend the public authorities law, in relation to establishing
a parking placard review board

 
PURPOSE OR GENERAL IDEA OF BILL:

To establish a review board that will examine the impact of placard use
upon congestion in New York City.

 
SUMMARY OF SPECIFIC PROVISIONS:

Section 1 adds a new article 12 to the public authorities law, creating
a parking placard review board. The board will consist of a chair and
fourteen members, tasked with assessing the impact of parking placards
upon congestion and establishing criteria for the retention of existing
placards and the distribution of new placards.  It shall consider
factors including how often placards are misused, how often complaints

related to placards are received, the effectiveness of any efforts that
have already been implemented to address this issue, and enforcement of
penalties.

Section 2 provides the effective date.

 
JUSTIFICATION:

In New York City, parking placards are routinely issued by city, state
and federal entities, affording holders the benefit of convenient and
free parking. According to the 2018 Fix NYC Advisory Panel report, New
York City has issued about 160,500 placards. The fact that such a high
number of placards are handed out contributes significantly to
congestion in the city. As a result, more people are driving into the
city, clogging streets, increasing traffic levels and exacerbating the
already existent issue of congestion. Efforts must be made to curb the
levels of congestion in the city and not to maintain a scheme which
exacerbates it further.

New York City has made some efforts to address the problem, including
enacting legislation to require a five year placard use plan, reporting
on the number of summons issued in the city for placard abuse, evaluat-
ing specific areas throughout the city to identify illegal parking and
increasing fines for fraudulent use of placards.  However, additional
measures must be taken to truly ameliorate the impact that rampant plac-
ard misuse has had upon congestion. It is critical that there be collab-
oration among the relevant city, state and federal players to find a
solution to this predicament.

This bill creates a parking placard review board, which will have city,
state and federal representation, tasked with reviewing the impact of
parking placard use. The board will issue a final report and make recom-
mendations regarding the impact of parking placards upon congestion and
shall establish criteria for the retention of existing placards and the
distribution of new placards. It shall consider factors including how
often placards are misused, how often complaints related- to placards
are received, the effectiveness of any efforts that have already been
implemented to address this issue, and enforcement of penalties.
The factors that the board must consider incorporate recommendations
laid out in 2018 reports issued by Fix NYC and the Metropolitan Trans-
portation Sustainability Advisory Workgroup. Creating a review board as
set out in this bill is a necessary measure towards gaining an accurate
picture of the true impact of placard use, ensuring accountability,
identifying effective solutions and eventually, improving congestion
levels.

 AN ACT to amend the public authorities law, in relation to  establishing
   a parking placard review board
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:

   Section 1. The public authorities law is amended by adding a new arti-
 cle 12 to read as follows:
                                ARTICLE 12
                       PARKING PLACARD REVIEW BOARD
 SECTION 3985. PARKING PLACARD REVIEW BOARD.
   § 3985. PARKING PLACARD REVIEW BOARD. 1. THERE IS HEREBY  CREATED  THE
 PARKING  PLACARD REVIEW "BOARD", HEREINAFTER REFERRED TO AS THE "BOARD",
 WHICH SHALL CONSIST OF A CHAIR AND FOURTEEN MEMBERS; THREE MEMBERS  UPON
 THE  RECOMMENDATION  OF  THE GOVERNOR, ONE OF WHOM SHALL BE THE CHAIR OF
 THE BOARD AND ONE OF WHOM SHALL BE THE  COMMISSIONER  OF  THE  NEW  YORK
 STATE DEPARTMENT OF TRANSPORTATION OR HIS OR HER DESIGNEE; THREE MEMBERS
 UPON  THE  RECOMMENDATION  OF  THE MAYOR OF THE CITY OF NEW YORK, ONE OF
 WHOM SHALL BE THE COMMISSIONER OF THE NEW YORK CITY DEPARTMENT OF TRANS-
 PORTATION OR HIS OR HER DESIGNEE AND ONE OF WHOM SHALL BE THE CHANCELLOR
 OF THE NEW YORK CITY DEPARTMENT OF EDUCATION OR HIS OR HER DESIGNEE; TWO
 MEMBERS UPON THE  RECOMMENDATION  OF  THE  TEMPORARY  PRESIDENT  OF  THE
 SENATE; TWO MEMBERS UPON THE RECOMMENDATION OF THE SPEAKER OF THE ASSEM-
 BLY,  ONE  OF  WHOM SHALL BE THE CHIEF JUDGE OF NEW YORK STATE OR HIS OR
 HER DESIGNEE; ONE MEMBER WHO SHALL BE THE EXECUTIVE DIRECTOR OF THE PORT
 AUTHORITY OF NEW YORK AND NEW JERSEY OR HIS OR HER DESIGNEE; ONE  MEMBER
 WHO  SHALL  BE THE CHAIRMAN OF THE METROPOLITAN TRANSPORTATION AUTHORITY
 OR HIS OR HER DESIGNEE; ONE MEMBER WHO SHALL BE THE DISTRICT ATTORNEY OF
 THE COUNTY OF NEW YORK OR HIS OR HER DESIGNEE; AND ONE MEMBER WHO  SHALL
 BE  FROM  THE  OFFICE OF THE ASSISTANT DIRECTOR OF THE FEDERAL BUREAU OF
 INVESTIGATION NEW YORK FIELD OFFICE OR HIS OR HER DESIGNEE.
   2. THE BOARD SHALL UNDERTAKE A REVIEW OF THE IMPACT OF PARKING PLACARD
 USE WITHIN THE CITY OF NEW YORK. THE BOARD SHALL ISSUE  A  FINAL  REPORT
 AND  MAKE RECOMMENDATIONS RELATED TO THE IMPACT OF PARKING PLACARDS UPON

 CONGESTION AND SHALL ESTABLISH CRITERIA FOR THE  RETENTION  OF  EXISTING
 PARKING PLACARDS AND THE DISTRIBUTION OF NEW PARKING PLACARDS, AND SHALL
 CONSIDER FACTORS INCLUDING, BUT NOT LIMITED TO:
   (A) THE IMPACT OF PARKING PLACARDS UPON CONGESTION;
   (B)  HOW OFTEN PARKING PLACARDS ARE MISUSED, INCLUDING ILLEGAL PARKING
 AT BUS STOPS, IN LOADING ZONES AND AT UNPAID METERS;
   (C) THE EFFECTIVENESS OF ANY MEASURES THAT HAVE  ALREADY  BEEN  IMPLE-
 MENTED TO ADDRESS PARKING PLACARDS, INCLUDING LEGISLATION ENACTED BY THE
 CITY  OF  NEW  YORK,  AND HOW SUCH MEASURES MAY BE IMPROVED AND EXPANDED
 UPON;
   (D) THE NUMBER OF PARKING PLACARD COMPLAINTS THAT ARE RECEIVED AND THE
 RESPONSE AND RESOLUTION OF SUCH COMPLAINTS;
   (E) REQUIRING ENTITIES WHO ISSUE PARKING PLACARDS TO IMPLEMENT A CEIL-
 ING ON THE NUMBER OF PLACARDS ISSUED;
   (F) ELIMINATING RESERVED OR DEDICATED  PARKING  FOR  INDIVIDUALS  WITH
 PLACARDS; AND
   (G)  ENFORCEMENT  OF PENALTIES FOR PARKING PLACARD MISUSE BY AN ENTITY
 WITH INDEPENDENCE FROM THE INDIVIDUALS IT WOULD NEED TO ENFORCE.
   3. THE BOARD SHALL, WITHIN SIX MONTHS  OF  CONVENING,  ISSUE  A  FINAL
 REPORT AND RECOMMENDATIONS TO THE GOVERNOR, THE MAYOR OF THE CITY OF NEW
 YORK,  THE  TEMPORARY PRESIDENT OF THE SENATE, THE SPEAKER OF THE ASSEM-
 BLY, THE COMMISSIONER OF THE NEW YORK STATE  DEPARTMENT  OF  TRANSPORTA-
 TION,  THE  COMMISSIONER  OF THE NEW YORK CITY DEPARTMENT OF TRANSPORTA-
 TION, THE CHANCELLOR OF THE NEW YORK CITY DEPARTMENT OF  EDUCATION,  THE
 EXECUTIVE DIRECTOR OF THE PORT AUTHORITY OF NEW YORK AND NEW JERSEY, THE
 CHAIRMAN  OF  THE  METROPOLITAN  TRANSPORTATION  AUTHORITY, THE DISTRICT
 ATTORNEY OF THE COUNTY OF NEW YORK, AND THE ASSISTANT  DIRECTOR  OF  THE
 FEDERAL BUREAU OF INVESTIGATION NEW YORK FIELD OFFICE.
   4.  THE  CITY  OF  NEW  YORK AND ANY STATE AGENCY, AUTHORITY OR OFFICE
 SHALL PROVIDE ANY ASSISTANCE NECESSARY TO ASSIST IN  THE  COMPLETION  OF
 THE BOARD'S WORK AND PROMPTLY RESPOND TO ANY REQUESTS FOR INFORMATION OR
 CONSULTATION CONSISTENT WITH THE PURPOSES OF THIS SECTION.
   5. MEMBERS OF THE BOARD SHALL SERVE WITHOUT COMPENSATION.
   § 2. This act shall take effect immediately.
