BILL NUMBER: S8737 SPONSOR: HELMING TITLE OF BILL: An act to amend the alcoholic beverage control law, in relation to licensing restrictions for manufacturers and wholesalers of alcoholic beverages on licensees who sell at retail for on-premises consumption; and to repeal certain provisions of such law relating thereto; and providing for the repeal of certain provisions upon the expiration ther- eof PURPOSE: To make technical corrections and remedies of metes and bounds to continue the operation of a hotel in Canandaigua, NY to maintain its ability to hold a retail liquor license for on-premise consumption and continue the approval of an exemption on restrictions on manufacturers, wholesalers, and retailers from sharing an interest in a liquor license. SUMMARY OF PROVISIONS:
Section 1 removes the retailer metes and bounds from section 101.a of ABC law and inserts language of metes and bounds for the wholesaler or manufacturer. Sections 2 through 4 insert the retailer metes and bounds into the ABC law. Section 5 is the effective date. JUSTIFICATION: This legislation seeks technical amendments to the ABC law based in order to align the metes and bounds for the hotel on Canandaigua Lake, NY, that has been approved for liquor licenses, historically after change of ownership and the pursuant legislative approval of the licenses since 1995. While there have been two additional legislative actions in the past 25 years on this legislation, the technical corrections had not been flagged until recently. This legislation has been introduced in order to act swiftly to continue to abide by all ABC laws. The ground-up rebuild of the former Inn on the Lake, The Lake House on Canandaigua Lake will be a showcase and point of pride for NYS and beyond. The world-class hotel will be a tourist destination and continue to provide community access to the iconic Sand Bar, which is a perennial favorite of locals and tourists, alike. The investment put into the hotel and community by the family that has owned and rebuilt the Lake House exemplifies the commitment to be an economic driver for the area. There are 42 newly built public access docks along the lakefront, as well as integrated programming with its neighbor, a charitable organiza- tion promoting New York's agricultural, food, and beverage industries. This legislation is supported locally, and necessary in order to provide for the operation of the hotel, which has a significant economic and local impact in the Canandaigua community. This act shall take effect immediately; provided, however, that upon the sale or transfer of the parcels detailed in clause (C) of subparagraph (ii) of paragraph (a) of subdivision 1 of section 101 of the alcoholic beverage control law, such clause shall expire and be deemed repealed unless the licensee immediately obtains a leasehold upon such sale or transfer of such parcel as part of the sale or transfer. If the licensee obtains such a leasehold, the clause pertaining to such parcel shall expire and be deemed repealed upon the end or termination of such lease. The state liquor authority shall notify the legislative bill drafting commission upon notification by the licensee of the sale, transfer or terminiation of the leasehold, or non-renewal of the lease- hold of the parcel detailed in clause (C) of subparagraph (ii) of para- graph (a) of subdivision 1 of section 101 of the alcoholic beverage law in order that the commission may maintain an accurate and timely effec- tive data base of the official text of the laws of the state of New York in furtherance of effectuating the provisions of section 44 of the legislative law and section 70-b of the public officers law.
