TITLE OF BILL:

An act to amend the environmental conservation law, in relation to
providing that one hundred percent of in-state sales of new passenger
cars and trucks shall be zero-emissions by two thousand thirty-five

 
PURPOSE:

Amends the environmental conservation law, in relation to providing that
one hundred percent of in-state sales of new passenger cars and trucks
shall be zero-emissions by two thousand thirty-five

 
SUMMARY OF PROVISIONS:

Section 1 amends the environmental conservation law by adding section
75-0121. This section declares a zero-emissions goal for the state of
New York in relation to cars and trucks. The goal is stated as
follows,to ensure that one hundred percent of in-state sales of new

passenger cars and trucks shall be zero-emissions by 2035, One hundred
percent of medium-duty and heavy-duty vehicles are to be zero-emissions
by 2045, and one hundred percent of off-road vehicles and equipment by
2035 where feasible.

Furthermore, the council is directed by January 31, 2021, to develop a
zero-emissions vehicle market development strategy. Additionally, the
Department of Motor Vehicles and the Department of Transportation are
directed to identify near term actions and investment strategies to
improve clean transportation, sustainable freight and transit options,
while continuing a "fix-it-first" approach to our transportation system
where feasible on or before January 15, 2021.

  Section 2 establishes the effective date.

 
JUSTIFICATION:

New  York's  Climate Change Act outlines nation leading climate targets.
To reach the goal of 85% reduction in greenhouse gas emissions  by  2050
we  need  to  aggressively pursue bench marks that will reduce emissions
from our personal vehicles. Personal transportation accounts for roughly
20% of American's greenhouse gas emissions. By  eliminating  this  as  a
source  of  emissions,  we  are  one  step closer to meeting our climate
change goals.

 AN ACT to amend the  environmental  conservation  law,  in  relation  to
   providing  that one hundred percent of in-state sales of new passenger
   cars and trucks shall be zero-emissions by two thousand thirty-five

   THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section  1.  The environmental conservation law is amended by adding a
 new section 75-0121 to read as follows:
 § 75-0121. ZERO-EMISSIONS CARS AND TRUCKS.
   1. IT SHALL BE A GOAL  OF  THE  STATE  THAT  ONE  HUNDRED  PERCENT  OF
 IN-STATE  SALES OF NEW PASSENGER CARS AND TRUCKS SHALL BE ZERO-EMISSIONS
 BY TWO THOUSAND THIRTY-FIVE.  IT SHALL BE A FURTHER GOAL  OF  THE  STATE
 THAT  ONE  HUNDRED PERCENT OF MEDIUM-DUTY AND HEAVY-DUTY VEHICLES IN THE
 STATE BE ZERO-EMISSIONS BY TWO THOUSAND FORTY-FIVE  FOR  ALL  OPERATIONS
 WHERE FEASIBLE. IT SHALL BE FURTHER A GOAL OF THE STATE TO TRANSITION TO
 ONE  HUNDRED  PERCENT  ZERO-EMISSIONS OFF-ROAD VEHICLES AND EQUIPMENT BY
 TWO THOUSAND THIRTY-FIVE WHERE FEASIBLE.
   2. THE COUNCIL, TO THE EXTENT CONSISTENT WITH STATE AND  FEDERAL  LAW,
 SHALL DEVELOP AND PROPOSE:
   A.  PASSENGER  VEHICLE  AND  TRUCK  REGULATIONS  REQUIRING  INCREASING
 VOLUMES OF NEW ZERO-EMISSIONS VEHICLES SOLD IN  THE  STATE  TOWARDS  THE
 TARGET  OF ONE HUNDRED PERCENT OF IN-STATE SALES BY TWO THOUSAND THIRTY-
 FIVE.
   B. MEDIUM-DUTY AND HEAVY-DUTY VEHICLE REGULATIONS REQUIRING INCREASING
 VOLUMES OF NEW ZERO-EMISSIONS TRUCKS AND BUSES SOLD AND OPERATED IN  THE
 STATE TOWARDS THE TARGET OF ONE HUNDRED PERCENT OF THE FLEET TRANSITION-
 ING  TO  ZERO-EMISSIONS  VEHICLES  BY TWO THOUSAND FORTY-FIVE EVERYWHERE
 FEASIBLE.
   C. STRATEGIES, IN COORDINATION  WITH  OTHER  STATE  AGENCIES  AND  THE
 FEDERAL  ENVIRONMENTAL PROTECTION AGENCY, TO ACHIEVE ONE HUNDRED PERCENT
 ZERO-EMISSIONS FROM OFF-ROAD VEHICLES AND EQUIPMENT  OPERATIONS  IN  THE
 STATE  BY  TWO THOUSAND THIRTY-FIVE.   IN IMPLEMENTING THE PROVISIONS OF

 THIS PARAGRAPH, THE COUNCIL SHALL ACT  CONSISTENTLY  WITH  TECHNOLOGICAL
 FEASIBILITY AND COST-EFFECTIVENESS.
   3. THE COUNCIL, IN CONSULTATION WITH THE DEPARTMENT OF ECONOMIC DEVEL-
 OPMENT,  THE  NEW  YORK STATE ENERGY RESEARCH AND DEVELOPMENT AUTHORITY,
 THE PUBLIC SERVICE COMMISSION, THE  DEPARTMENT  OF  TRANSPORTATION,  THE
 DEPARTMENT  OF  MOTOR VEHICLES, AND OTHER STATE AGENCIES, LOCAL AGENCIES
 AND THE PRIVATE SECTOR, SHALL DEVELOP A  ZERO-EMISSIONS  VEHICLE  MARKET
 DEVELOPMENT  STRATEGY  BY JANUARY THIRTY-FIRST, TWO THOUSAND TWENTY-ONE,
 AND AN UPDATE EVERY THREE YEARS THEREAFTER, THAT:
   A. ENSURES COORDINATED AND EXPEDITIOUS IMPLEMENTATION OF THE SYSTEM OF
 POLICIES, PROGRAMS AND REGULATIONS NECESSARY TO ACHIEVE  THE  GOALS  AND
 ORDERS ESTABLISHED BY THIS SECTION.
   B.  OUTLINES  STATE  AGENCIES'  ACTIONS  TO SUPPORT NEW AND USED ZERO-
 EMISSIONS VEHICLE MARKETS FOR BROAD ACCESSIBILITY FOR ALL  RESIDENTS  OF
 THIS STATE.
   4.  THE  COUNCIL,  THE  NEW YORK STATE ENERGY RESEARCH AND DEVELOPMENT
 AUTHORITY, THE PUBLIC SERVICE COMMISSION AND OTHER STATE AGENCIES, SHALL
 USE EXISTING AUTHORITIES TO ACCELERATE DEPLOYMENT OF AFFORDABLE  FUELING
 AND CHARGING OPTIONS FOR ZERO-EMISSIONS VEHICLES, IN WAYS THAT SERVE ALL
 COMMUNITIES  AND  PARTICULARLY LOW-INCOME AND DISADVANTAGED COMMUNITIES,
 CONSISTENT WITH STATE AND FEDERAL LAW.
   5. THE DEPARTMENT OF MOTOR VEHICLES AND THE DEPARTMENT OF  TRANSPORTA-
 TION,  IN CONSULTATION WITH THE OTHER STATE AGENCIES, SHALL ON OR BEFORE
 JULY FIFTEENTH, TWO THOUSAND TWENTY-ONE, IDENTIFY NEAR TERM ACTIONS  AND
 INVESTMENT  STRATEGIES  TO  IMPROVE  CLEAN  TRANSPORTATION,  SUSTAINABLE
 FREIGHT AND TRANSIT OPTIONS, WHILE CONTINUING A "FIX-IT-FIRST"  APPROACH
 TO OUR TRANSPORTATION SYSTEM, INCLUDING WHERE FEASIBLE:
   A. SUPPORTING BICYCLE, PEDESTRIAN, AND MICRO-MOBILITY OPTIONS, PARTIC-
 ULARLY  IN  LOW-INCOME  AND  DISADVANTAGED  COMMUNITIES IN THE STATE, BY
 INCORPORATING SAFE AND ACCESSIBLE  INFRASTRUCTURE  INTO  PROJECTS  WHERE
 APPROPRIATE.
   B.  SUPPORTING  LIGHT,  MEDIUM, AND HEAVY-DUTY ZERO-EMISSIONS VEHICLES
 AND INFRASTRUCTURE AS PART  OF  LARGER  TRANSPORTATION  PROJECTS,  WHERE
 APPROPRIATE.
   6.  TO  SUPPORT  THE TRANSITION AWAY FROM FOSSIL FUELS CONSISTENT WITH
 THE GOALS ESTABLISHED IN THIS SECTION AND THE STATE'S  STATEWIDE  GREEN-
 HOUSE  GAS EMISSIONS LIMITS GOALS SET FORTH IN THIS ARTICLE, THE DEPART-
 MENT, IN CONSULTATION WITH OTHER  STATE,  LOCAL  AND  FEDERAL  AGENCIES,
 SHALL EXPEDITE REGULATORY PROCESSES TO REPURPOSE AND TRANSITION UPSTREAM
 AND  DOWNSTREAM  OIL  PRODUCTION  FACILITIES, WHILE SUPPORTING COMMUNITY
 PARTICIPATION, LABOR STANDARDS, AND PROTECTION OF PUBLIC HEALTH,  SAFETY
 AND  THE  ENVIRONMENT. THE AGENCIES SHALL REPORT ON PROGRESS AND PROVIDE
 AN ACTION PLAN, INCLUDING NECESSARY  CHANGES  IN  REGULATIONS,  LAWS  OR
 RESOURCES, BY JULY FIFTEENTH, TWO THOUSAND TWENTY-ONE.
   7.  THE  COUNCIL,  IN  CONSULTATION  WITH  OTHER STATE AGENCIES, SHALL
 DEVELOP AND PROPOSE STRATEGIES TO CONTINUE THE STATE'S  CURRENT  EFFORTS
 TO  REDUCE THE CARBON INTENSITY OF FUELS BEYOND TWO THOUSAND THIRTY WITH
 CONSIDERATION OF THE FULL LIFE CYCLE OF CARBON.
   8. THE DEPARTMENT, IN CONSULTATION WITH  THE  DEPARTMENT  OF  ECONOMIC
 DEVELOPMENT  AND OTHER LOCAL AND FEDERAL AGENCIES, SHALL DEVELOP STRATE-
 GIES, RECOMMENDATIONS AND ACTIONS BY JULY FIFTEENTH, TWO THOUSAND  TWEN-
 TY-ONE TO MANAGE AND EXPEDITE THE RESPONSIBLE CLOSURE AND REMEDIATION OF
 FORMER OIL EXTRACTION SITES AS THE STATE TRANSITIONS TO A CARBON-NEUTRAL
 ECONOMY.
   § 2. This act shall take effect immediately.

PURPOSE OR GENERAL IDEA OF BILL:

To decrease greenhouse gas emissions and air pollution from the trans-
portation sector.

 
SUMMARY OF PROVISIONS:

This bill would:

* amend the Environmental Conservation Law by adding a new § 19-0306-b
and establishing a State zero-emissions goal for cars and trucks to be
accomplished as follows:

* 100% of in-state sales of new passenger cars and trucks would be zero-
emissions by 2035;

* 100% of medium-duty and heavy-duty vehicles would be zero-emissions by
2045; and

* 100% of off-road vehicles and equipment would be zero-emissions by
2035 where feasible;

* direct the Department of Environmental Conservation (DEC), in consul-
tation with other agencies, to:

* develop a zero-emissions vehicle market development strategy by Janu-
ary 1, 2022, and,

* identify near-term actions and investment strategies to improve
sustainable transportation and freight and transit options.

 
JUSTIFICATION:

The aggressive greenhouse gas emission reduction goals established in
the New York State Climate Leadership and Community Protection Act
(CLCPA) require aggressive action. Estimates indicate that personal
transportation accounts for roughly 20% of greenhouse gas emissions.
Establishing zero-emission goals and a strategy to eliminate these emis-
sions will be an important step in achieving the CLCPA goals.

 STATE BY TWO THOUSAND THIRTY-FIVE.   IN IMPLEMENTING THE  PROVISIONS  OF
 THIS PARAGRAPH, THE DEPARTMENT SHALL ACT CONSISTENTLY WITH SAFETY, TECH-
 NOLOGICAL FEASIBILITY AND COST-EFFECTIVENESS.

 AND  OTHER  INTERESTED  PARTIES,  SHALL DEVELOP A ZERO-EMISSIONS VEHICLE
 MARKET DEVELOPMENT STRATEGY BY JANUARY THIRTY-FIRST, TWO THOUSAND  TWEN-
 TY-TWO, AND AN UPDATE EVERY THREE YEARS THEREAFTER, THAT:

 AUTHORITY, THE DEPARTMENT OF MOTOR VEHICLES AND THE DEPARTMENT OF TRANS-
 PORTATION, IN CONSULTATION WITH THE OTHER STATE AGENCIES,  SHALL  ON  OR
 BEFORE  JULY  FIFTEENTH,  TWO  THOUSAND  TWENTY-TWO,  IDENTIFY NEAR TERM
 ACTIONS AND INVESTMENT STRATEGIES TO IMPROVE SUSTAINABLE TRANSPORTATION,
 FREIGHT AND TRANSIT OPTIONS, INCLUDING WHERE FEASIBLE:

 APPROPRIATE.
