2021-A10417 (ACTIVE) - Summary
Authorizes the county of Suffolk to convey to the Hampton Bays Water District, an easement in Meschutt Beach County Park for installation of a subaqueous water pipe crossing, provided that the county of Suffolk dedicate an amount equal to or greater than the fair market value of the easement interest being alienated pursuant to section one of this act to the acquisition of new parklands and/or capital improvements to existing park and recreational facilities.

S T A T E O F N E W Y O R K ________________________________________________________________________ 10417 I N A S S E M B L Y May 13, 2022 ___________ Introduced by COMMITTEE ON RULES -- (at request of M. of A. Thiele) -- read once and referred to the Committee on Local Governments AN ACT in relation to authorizing the county of Suffolk to convey by appropriate instruments to the Hampton Bays Water District, an ease- ment in Meschutt Beach County Park, for installation of a subaqueous water pipe crossing THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The county of Suffolk, acting by and through its governing body, is hereby authorized to convey by appropriate instruments to the Hampton Bays Water District, an easement in Meschutt Beach County Park described in section three of this act, for installation of a subaqueous water pipe crossing. § 2. The authorization provided in section one of this act shall be effective only upon the condition that the county of Suffolk dedicate an amount equal to or greater than the fair market value of the easement interest being alienated pursuant to section one of this act to the acquisition of new parklands and/or capital improvements to existing park and recreational facilities. § 3. The easement to be conveyed by the county of Suffolk pursuant to the provisions of this act is described as follows: All that certain lot, piece of parcel of land situated and lying and being at Shinnecock Hills, Town of Southampton, County of Suffolk and State of New York, known and designated within District 900, Section189, Block 2, Lot 001. Said parcel also known as "Meschutt Beach," being specifically bound and described as follows: BEGINNING at a point formed by the southerly right-of-way line of Sunset Avenue and the easterly right-of-way line of Newtown Road. THENCE running in an easterly direction, a distance of approximately 843 feet along the southerly right-of-way line of Sunset Avenue to a point inter- sected by the southerly right of-way line of Sunset Avenue and the westerly boundary line of District 900, Section 188, Block 03, Lot 001. THENCE from a point intersected by the southerly right-of-way line of Sunset Avenue and the westerly boundary line of District 900, Section EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted.
