PALUMBO -- read twice and ordered print- ed, and when printed to be committed to the Committee on Local Govern- ment IN ASSEMBLY -- Introduced by M. of A. THIELE -- read once and referred to the Committee on Local Governments AN ACT to provide procedures relating to the adoption and submission of an annual budget by the Trustees of the Freeholders and Commonalty of the town of Southampton THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: Section 1. The Trustees of the Freeholders and Commonalty of the town of Southampton shall, after public hearing, prepare and adopt an annual budget in the manner prescribed in section 181 of the town law. The budget shall be in the format prescribed in section 107 of the town law. The budgetary controls of section 181-a of the town law, and the inde- pendent audit requirements of section 181-b of the town law shall apply. The town of Southampton budget officer shall affix such budget to the annual town budget, established pursuant to section 109 of the town law, as a part thereof. No change shall be made by the budget officer or the town board to the budget submitted by the Trustees of the Freeholders and Commonalty of the town of Southampton. § 2. The annual budget shall not contain a tax levy percentage increase greater than the limit upon the real property tax levy for the town of Southampton for the coming fiscal year pursuant to section 3-c of the general municipal law, except if the town board approves a resol- ution by a vote of sixty percent of the total voting power of such body, permitting the trustees to override such limit for such coming fiscal year only. § 3. This act shall take effect immediately and shall apply to all fiscal years beginning on and after January 1, 2022.
