Requires any public school located in a city with a population of one million or more to offer a remote learning option to all primary and secondary students when such public school is located in a county determined by the federal centers for disease control and prevention to have a substantial or high level of community transmission of COVID-19.

 AN ACT to require any public school located in a city with a  population
   of  one  million or more to provide a remote learning option when such
   public school is located in a county where community  transmission  of
   COVID-19 is at a substantial or high level
 
   THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
 BLY, DO ENACT AS FOLLOWS:
 
   Section 1. Notwithstanding any law, rule, regulation or order  to  the
 contrary,  any  public school located in a city with a population of one
 million or more shall provide a remote learning option  to  all  primary
 and  secondary  students  when such public school is located in a county
 determined by the federal centers for disease control and prevention  to
 have  a   substantial   or high   level   of   community transmission of
 COVID-19. Such remote learning option shall remain available  until  the
 federal  centers  for  disease  control  and  prevention determines that
 community transmission in such county is at a low or moderate level.
   § 2. This act shall take effect immediately.
